Tan\u0131mlar<\/p>\n<p><b>Ama\u00e7<\/b><\/p>\n<p><b>MADDE 1\u00a0\u2013\u00a0<\/b>(1) Bu Y\u00f6netmeli\u011fin amac\u0131; i\u015f\u00a0sa\u011fl\u0131\u011f\u0131\u00a0ve g\u00fcvenli\u011fi hizmetlerinde g\u00f6revli i\u015fyeri hekimlerinin ve di\u011fer sa\u011fl\u0131k personelinin nitelikleri, belgelendirilmeleri, e\u011fitimleri, g\u00f6rev, yetki ve sorumluluklar\u0131\u00a0ile\u00a0\u00e7al\u0131\u015fma usul ve esaslar\u0131n\u0131d\u00fczenlemektir.<\/p>\n<p><b>Kapsam<\/b><\/p>\n<p><b>MADDE 2\u00a0\u2013\u00a0<\/b>(1) Bu Y\u00f6netmelik,\u00a020\/6\/2012\u00a0tarihli ve 6331 say\u0131l\u0131\u00a0\u0130\u015f\u00a0Sa\u011fl\u0131\u011f\u0131\u00a0ve G\u00fcvenli\u011fi Kanunu kapsam\u0131nda yer alan i\u015fyerleri ile e\u011fitim kurumlar\u0131n\u0131\u00a0kapsar.<\/p>\n<p><b>Dayanak<\/b><\/p>\n<p><b>MADDE 3\u00a0\u2013\u00a0<\/b>(1) Bu Y\u00f6netmelik; 6331 say\u0131l\u0131\u00a0\u0130\u015f\u00a0Sa\u011fl\u0131\u011f\u0131\u00a0ve G\u00fcvenli\u011fi Kanununun 30 uncu,\u00a09\/1\/1985\u00a0tarihli ve 3146 say\u0131l\u0131\u00a0\u00c7al\u0131\u015fma ve Sosyal G\u00fcvenlik Bakanl\u0131\u011f\u0131n\u0131n Te\u015fkilat ve G\u00f6revleri Hakk\u0131nda Kanunun 2 ve 12\u00a0nci\u00a0maddelerine dayan\u0131larak haz\u0131rlanm\u0131\u015ft\u0131r.<\/p>\n<p><b>Tan\u0131mlar<\/b><\/p>\n<p><b>MADDE 4\u00a0\u2013<\/b>\u00a0(1) Bu Y\u00f6netmelikte ge\u00e7en:<\/p>\n<p>a) Bakanl\u0131k:\u00a0\u00c7al\u0131\u015fma ve Sosyal G\u00fcvenlik Bakanl\u0131\u011f\u0131n\u0131,<\/p>\n<p>b) Di\u011fer sa\u011fl\u0131k personeli:\u00a0\u0130\u015f\u00a0sa\u011fl\u0131\u011f\u0131\u00a0ve g\u00fcvenli\u011fi hizmetlerinde g\u00f6revlendirilmek\u00a0\u00fczere Bakanl\u0131k\u00e7a belgelendirilmi\u015fhem\u015fire, sa\u011fl\u0131k memuru, acil t\u0131p teknisyeni ve\u00a0\u00e7evre sa\u011fl\u0131\u011f\u0131\u00a0teknisyeni diplomas\u0131na sahip olan ki\u015filer ile Bakanl\u0131k\u00e7a verilen i\u015fyeri hem\u015fireli\u011fi belgesine sahip ki\u015fileri,<\/p>\n<p>c) E\u011fiticilerin e\u011fitimi belgesi: En az 40 saatlik e\u011fitim sonunda kamu kurum ve kurulu\u015flar\u0131,\u00a0\u00fcniversiteler veya8\/2\/2007\u00a0tarihli ve 5580 say\u0131l\u0131\u00a0\u00d6zel\u00a0\u00d6\u011fretim Kurumlar\u0131\u00a0Kanununa g\u00f6re yetkilendirilen kurumlar taraf\u0131ndan tek bir program sonucunda verilen e\u011fiticilerin e\u011fitimi belgesini,<\/p>\n<p>\u00e7)\u00a0E\u011fitim kurumu:\u00a0\u0130\u015fyeri hekimli\u011fi ve di\u011fer sa\u011fl\u0131k personeli e\u011fitimlerini vermek\u00a0\u00fczere Bakanl\u0131k\u00e7a yetkilendirilen kamu kurum ve kurulu\u015flar\u0131,\u00a0\u00fcniversiteler ve 13\/1\/2011 tarihli ve 6102 say\u0131l\u0131\u00a0T\u00fcrk Ticaret Kanununa g\u00f6re faaliyet g\u00f6steren\u00a0\u015firketler taraf\u0131ndan kurulan m\u00fcesseseleri,<\/p>\n<p>d) E\u011fitim program\u0131: Uzaktan, y\u00fcz y\u00fcze ve\/veya uygulamal\u0131\u00a0e\u011fitim derslerinin tarih ve saatleri, asil ve yedek e\u011fiticileri, kat\u0131l\u0131mc\u0131lar\u0131\u00a0ile e\u011fitim mek\u00e2n\u0131\u00a0gibi unsurlardan ve bu unsurlara ili\u015fkin her t\u00fcrl\u00fc\u00a0bilgi ve belgeden olu\u015fan b\u00fct\u00fcnl\u00fc\u011f\u00fc,<\/p>\n<p>e) Genel M\u00fcd\u00fcrl\u00fck:\u00a0\u0130\u015f\u00a0Sa\u011fl\u0131\u011f\u0131\u00a0ve G\u00fcvenli\u011fi Genel M\u00fcd\u00fcrl\u00fc\u011f\u00fcn\u00fc,<\/p>\n<p>f)\u00a0\u0130SG-KAT\u0130P:\u00a0\u0130\u015f\u00a0sa\u011fl\u0131\u011f\u0131\u00a0ve g\u00fcvenli\u011fi hizmetleri ile ilgili i\u015f\u00a0ve i\u015flemlerin Genel M\u00fcd\u00fcrl\u00fck\u00e7e kay\u0131t, takip ve izlenmesi amac\u0131yla kullan\u0131lan\u00a0\u0130\u015f\u00a0Sa\u011fl\u0131\u011f\u0131\u00a0ve G\u00fcvenli\u011fi Kay\u0131t, Takip ve\u00a0\u0130zleme Program\u0131n\u0131,<\/p>\n<p>g)\u00a0\u0130\u015fyeri hekimi:\u00a0\u0130\u015f\u00a0sa\u011fl\u0131\u011f\u0131\u00a0ve g\u00fcvenli\u011fi alan\u0131nda g\u00f6rev yapmak\u00a0\u00fczere Bakanl\u0131k\u00e7a yetkilendirilmi\u015f\u00a0i\u015fyeri hekimli\u011fi belgesine sahip hekimi,<\/p>\n<p>\u011f) Sorumlu m\u00fcd\u00fcr:\u00a0\u0130\u015fyeri hekimli\u011fi ve i\u015f\u00a0g\u00fcvenli\u011fi uzmanl\u0131\u011f\u0131\u00a0e\u011fitici belgesine sahip olan, tam s\u00fcreli istihdam edilen ve e\u011fitim kurumlar\u0131n\u0131n i\u015f\u00a0ve i\u015flemlerinden Bakanl\u0131\u011fa kar\u015f\u0131\u00a0sorumlu olan ki\u015fiyi,<\/p>\n<p>ifade\u00a0eder.<\/p>\n<p>\u0130K\u0130NC\u0130\u00a0B\u00d6L\u00dcM<\/p>\n<p>\u0130\u015fverenin Y\u00fck\u00fcml\u00fcl\u00fckleri<\/p>\n<p><b>\u0130\u015fyeri hekimi ve di\u011fer sa\u011fl\u0131k personeli g\u00f6revlendirme y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc<\/b><\/p>\n<p><b>MADDE 5\u00a0\u2013<\/b>\u00a0(1) Mesleki risklerin\u00a0\u00f6nlenmesi ve bu risklerden\u00a0korunulmas\u0131na\u00a0y\u00f6nelik\u00a0\u00e7al\u0131\u015fmalar\u0131\u00a0da kapsayacak i\u015f\u00a0sa\u011fl\u0131\u011f\u0131\u00a0ve g\u00fcvenli\u011fi hizmetlerinin sunulmas\u0131\u00a0i\u00e7in i\u015fveren;<\/p>\n<p>a)\u00a0\u00c7al\u0131\u015fanlar\u0131\u00a0aras\u0131ndan 4\u00a0\u00fcnc\u00fc\u00a0maddenin birinci f\u0131kras\u0131n\u0131n (b) ve (g) bentlerindeki niteliklere sahip\u00a0\u00e7al\u0131\u015fanlar\u0131, i\u015fyerinin tehlike s\u0131n\u0131f\u0131\u00a0ve\u00a0\u00e7al\u0131\u015fan say\u0131s\u0131n\u0131\u00a0dikkate alarak i\u015fyeri hekimi ve di\u011fer sa\u011fl\u0131k personeli olarak g\u00f6revlendirir.<\/p>\n<p>b)\u00a0\u00c7al\u0131\u015fanlar\u0131\u00a0aras\u0131nda belirlenen niteliklere sahip personel bulunmamas\u0131\u00a0h\u00e2linde, bu y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fcn\u00fc\u00a0ortak sa\u011fl\u0131k ve g\u00fcvenlik birimlerinden veya Bakanl\u0131k\u00e7a yetkilendirilen Sa\u011fl\u0131k Bakanl\u0131\u011f\u0131\u2019na ba\u011fl\u0131\u00a0birimlerden hizmet alarak yerine getirebilir.<\/p>\n<p>c) Bu Y\u00f6netmelikte belirtilen niteliklere ve gerekli belgeye sahip olmas\u0131\u00a0halinde,\u00a0\u00e7al\u0131\u015fan say\u0131s\u0131\u00a0ve tehlike s\u0131n\u0131f\u0131n\u0131dikkate alarak kendi i\u015fyerinde, i\u015fyeri hekimli\u011fi ve di\u011fer sa\u011fl\u0131k personeli g\u00f6revini\u00a0\u00fcstlenebilir.<\/p>\n<p>\u00e7) Tam s\u00fcreli i\u015fyeri hekimi g\u00f6revlendirilen i\u015fyerlerinde, di\u011fer sa\u011fl\u0131k personeli g\u00f6revlendirilmesi zorunlu de\u011fildir.<\/p>\n<p>(2)\u00a0\u0130\u015fveren, g\u00f6revlendirdi\u011fi ki\u015fi veya hizmet ald\u0131\u011f\u0131\u00a0kurum ve kurulu\u015flar\u0131n g\u00f6revlerini yerine getirmeleri amac\u0131yla ara\u00e7, gere\u00e7, mek\u00e2n ve zaman gibi gerekli b\u00fct\u00fcn ihtiya\u00e7lar\u0131n\u0131\u00a0kar\u015f\u0131lar.<\/p>\n<p>(3)\u00a0\u0130\u015fveren, i\u015fyerinde sa\u011fl\u0131k ve g\u00fcvenlik hizmetlerini y\u00fcr\u00fctenler aras\u0131nda i\u015fbirli\u011fi ve koordinasyonu sa\u011flar.<\/p>\n<p>(4)\u00a0\u0130\u015fveren, g\u00f6revlendirdi\u011fi ki\u015fi veya hizmet ald\u0131\u011f\u0131\u00a0kurum ve kurulu\u015flar taraf\u0131ndan i\u015f\u00a0sa\u011fl\u0131\u011f\u0131\u00a0ve g\u00fcvenli\u011fi ile ilgili mevzuata uygun olan ve yaz\u0131l\u0131\u00a0olarak bildirilen tedbirleri yerine getirir.<\/p>\n<p>(5)\u00a0\u0130\u015fveren, yerine getirilmeyen hususlar varsa gerek\u00e7esi ile birlikte talepte bulunan ki\u015fiye yaz\u0131l\u0131\u00a0olarak bildirir ve bu yaz\u0131\u015fmalar\u0131n i\u015fyerinde d\u00fczenli olarak ar\u015fivlenmesini sa\u011flar.<\/p>\n<p>(6)\u00a0\u0130\u015fveren,\u00a0\u00e7al\u0131\u015fanlar\u0131n sa\u011fl\u0131k ve g\u00fcvenli\u011fini etkiledi\u011fi bilinen veya etkilemesi muhtemel konular hakk\u0131nda; g\u00f6revlendirdi\u011fi ki\u015fi veya hizmet ald\u0131\u011f\u0131\u00a0kurum ve kurulu\u015flar\u0131, ba\u015fka i\u015fyerlerinden\u00a0\u00e7al\u0131\u015fmak\u00a0\u00fczere kendi i\u015fyerine gelen\u00e7al\u0131\u015fanlar\u0131\u00a0ve bunlar\u0131n i\u015fverenlerini bilgilendirir.<\/p>\n<p>(7)\u00a0\u0130\u015f\u00a0sa\u011fl\u0131\u011f\u0131\u00a0ve g\u00fcvenli\u011fi konusunda i\u015fyeri hekimi ve di\u011fer sa\u011fl\u0131k personeli g\u00f6revlendirmesi veya hizmet sat\u0131n almas\u0131\u00a0i\u015fverenin sorumluluklar\u0131n\u0131\u00a0etkilemez.<\/p>\n<p>(8)\u00a0\u0130\u015fveren, i\u015f\u00a0sa\u011fl\u0131\u011f\u0131\u00a0ve g\u00fcvenli\u011fi hizmetleri ile ilgili maliyeti\u00a0\u00e7al\u0131\u015fanlara yans\u0131tamaz.<\/p>\n<p>(9)\u00a0\u0130\u015fveren, 11 inci maddenin\u00a0\u00fc\u00e7\u00fcnc\u00fc\u00a0f\u0131kras\u0131nda belirtilen durumlarda, ilgili yarg\u0131\u00a0s\u00fcrecini takip eder ve sonucunu Genel M\u00fcd\u00fcrl\u00fc\u011fe bildirir.<\/p>\n<p><b>\u0130\u015fyeri sa\u011fl\u0131k ve g\u00fcvenlik birimi kurma y\u00fck\u00fcml\u00fc\u011f\u00fc<\/b><\/p>\n<p><b>MADDE 6\u00a0\u2013<\/b>\u00a0(1)\u00a0\u0130\u015fyeri hekimi ve i\u015f\u00a0g\u00fcvenli\u011fi uzman\u0131n\u0131n tam s\u00fcreli g\u00f6revlendirilmesi gereken durumlarda i\u015fveren, i\u015fyeri sa\u011fl\u0131k ve g\u00fcvenlik birimi kurar. Bu durumda,\u00a0\u00e7al\u0131\u015fanlar\u0131n tabi oldu\u011fu kanun h\u00fck\u00fcmleri sakl\u0131\u00a0kalmak kayd\u0131yla,\u00a022\/5\/2003\u00a0tarihli ve 4857 say\u0131l\u0131\u00a0\u0130\u015f\u00a0Kanununa g\u00f6re belirlenen haftal\u0131k\u00a0\u00e7al\u0131\u015fma s\u00fcresi dikkate al\u0131n\u0131r.<\/p>\n<p>(2)\u00a0\u0130\u015fveren tam s\u00fcreli i\u015fyeri hekimi\u00a0\u00e7al\u0131\u015ft\u0131rma y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc\u00a0olmasa dahi i\u015fyerinde g\u00f6rev yapacak olan i\u015fyeri hekimine\u00a0\u0130\u015f\u00a0Sa\u011fl\u0131\u011f\u0131\u00a0ve G\u00fcvenli\u011fi Hizmetleri Y\u00f6netmeli\u011finde belirlenen\u00a0kriterlere\u00a0uygun bir yer g\u00f6sterir ve ayn\u0131Y\u00f6netmeli\u011fin EK-1\u2019inde say\u0131lan malzemelerden i\u015fyeri hekimince talep edilenleri temin eder.<\/p>\n<p>\u00dc\u00c7\u00dcNC\u00dc\u00a0B\u00d6L\u00dcM<\/p>\n<p>\u0130\u015fyeri Hekiminin Nitelikleri, G\u00f6rev, Yetki ve Y\u00fck\u00fcml\u00fcl\u00fckleri ile<\/p>\n<p>\u00c7al\u0131\u015fma\u00a0Us\u00fbl\u00a0ve Esaslar\u0131<\/p>\n<p><b>\u0130\u015fyeri hekimlerinin nitelikleri ve g\u00f6revlendirilmeleri<\/b><\/p>\n<p><b>MADDE 7\u00a0\u2013<\/b>\u00a0(1)\u00a0\u0130\u015fverence i\u015fyeri hekimi olarak g\u00f6revlendirilecekler, bu Y\u00f6netmeli\u011fe g\u00f6re ge\u00e7erli i\u015fyeri hekimli\u011fi belgesine sahip olmak zorundad\u0131r.<\/p>\n<p>(2)\u00a0\u0130\u015fyeri hekimlerinin g\u00f6revlendirilmesinde, bu Y\u00f6netmeli\u011fe g\u00f6re hesaplanan\u00a0\u00e7al\u0131\u015fma s\u00fcreleri b\u00f6l\u00fcnerek birden fazla i\u015fyeri hekimine verilemez.<\/p>\n<p>(3) Vardiyal\u0131\u00a0\u00e7al\u0131\u015fma yap\u0131lan i\u015fyerlerinde i\u015fveren taraf\u0131ndan vardiyalara uygun\u00a0\u015fekilde g\u00f6revlendirme yap\u0131l\u0131r.<\/p>\n<p><b>\u0130\u015fyeri hekimli\u011fi belgesi<\/b><\/p>\n<p><b>MADDE 8\u00a0\u2013<\/b>\u00a0(1)\u00a0\u0130\u015fyeri hekimli\u011fi belgesi;<\/p>\n<p>a)\u00a0\u0130\u015fyeri hekimli\u011fi e\u011fitim program\u0131n\u0131\u00a0tamamlayan ve e\u011fitim sonunda Bakanl\u0131k\u00e7a yap\u0131lacak veya yapt\u0131r\u0131lacak i\u015fyeri hekimli\u011fi s\u0131nav\u0131nda ba\u015far\u0131l\u0131\u00a0olan hekimlere,<\/p>\n<p>b)\u00a0\u0130\u015f\u00a0sa\u011fl\u0131\u011f\u0131\u00a0veya i\u015f\u00a0sa\u011fl\u0131\u011f\u0131\u00a0ve g\u00fcvenli\u011fi bilim uzman\u0131\u00a0unvan\u0131na sahip olan Bakanl\u0131k\u00e7a yap\u0131lacak veya yapt\u0131r\u0131lacak i\u015fyeri hekimli\u011fi s\u0131nav\u0131nda ba\u015far\u0131l\u0131\u00a0olan hekimlere,<\/p>\n<p>c) Hekimlik diplomas\u0131na sahip i\u015f\u00a0sa\u011fl\u0131\u011f\u0131, i\u015f\u00a0sa\u011fl\u0131\u011f\u0131\u00a0ve g\u00fcvenli\u011fi bilim doktorlar\u0131na, i\u015f\u00a0sa\u011fl\u0131\u011f\u0131\u00a0ve g\u00fcvenli\u011fi alan\u0131nda yard\u0131mc\u0131l\u0131k s\u00fcresi\u00a0dahil\u00a0en az sekiz y\u0131l tefti\u015f\u00a0yapm\u0131\u015f\u00a0olan hekim i\u015f\u00a0m\u00fcfetti\u015flerine, Genel M\u00fcd\u00fcrl\u00fck ve ba\u011fl\u0131\u00a0birimlerinde i\u015f\u00a0sa\u011fl\u0131\u011f\u0131\u00a0ve g\u00fcvenli\u011fi alan\u0131nda en az sekiz y\u0131l fiilen\u00a0\u00e7al\u0131\u015fm\u0131\u015f\u00a0hekimlere istekleri halinde,<\/p>\n<p>EK-1\u2019deki\u00a0\u00f6rne\u011fine uygun olarak Genel M\u00fcd\u00fcrl\u00fck\u00e7e verilir.<\/p>\n<p><b>\u0130\u015fyeri hekimlerinin g\u00f6revleri<\/b><\/p>\n<p><b>MADDE 9\u00a0\u2013<\/b>\u00a0(1)\u00a0\u0130\u015fyeri hekimi, i\u015fyerinde bulunmas\u0131\u00a0halinde di\u011fer sa\u011fl\u0131k personeli ile birlikte\u00a0\u00e7al\u0131\u015f\u0131r.<\/p>\n<p>(2)\u00a0\u0130\u015fyeri hekimleri, i\u015f\u00a0sa\u011fl\u0131\u011f\u0131\u00a0ve g\u00fcvenli\u011fi hizmetleri kapsam\u0131nda a\u015fa\u011f\u0131daki g\u00f6revleri yapmakla y\u00fck\u00fcml\u00fcd\u00fcr:<\/p>\n<p>a) Rehberlik;<\/p>\n<p>1)\u00a0\u0130\u015f\u00a0sa\u011fl\u0131\u011f\u0131\u00a0ve g\u00fcvenli\u011fi hizmetleri kapsam\u0131nda\u00a0\u00e7al\u0131\u015fanlar\u0131n sa\u011fl\u0131k g\u00f6zetimi ve\u00a0\u00e7al\u0131\u015fma ortam\u0131n\u0131n g\u00f6zetimi ile ilgili i\u015fverene rehberlik yapmak.<\/p>\n<p>2)\u00a0\u0130\u015fyerinde yap\u0131lan\u00a0\u00e7al\u0131\u015fmalar ve yap\u0131lacak de\u011fi\u015fikliklerle ilgili olarak i\u015fyerinin tasar\u0131m\u0131, kullan\u0131lan maddeler de d\u00e2hil olmak\u00a0\u00fczere i\u015fin planlanmas\u0131, organizasyonu ve uygulanmas\u0131, ki\u015fisel koruyucu donan\u0131mlar\u0131n se\u00e7imi konular\u0131n\u0131n i\u015fsa\u011fl\u0131\u011f\u0131\u00a0ve g\u00fcvenli\u011fi mevzuat\u0131na ve genel i\u015f\u00a0sa\u011fl\u0131\u011f\u0131\u00a0kurallar\u0131na uygun olarak s\u00fcrd\u00fcr\u00fclmesini Bu gibi organizasyonlarda ge\u00e7en s\u00fcrelerden bir y\u0131l i\u00e7erisinde toplam be\u015f\u00a0i\u015f\u00a0g\u00fcn\u00fc\u00a0kadar\u0131\u00a0\u00e7al\u0131\u015fma s\u00fcresinden say\u0131l\u0131r ve bu s\u00fcreler sebebiyle i\u015fyeri hekiminin\u00a0\u00fccretinden herhangi bir kesinti yap\u0131lamaz.<\/p>\n<p><b>\u0130\u015fyeri hekiminin y\u00fck\u00fcml\u00fcl\u00fckleri<\/b><\/p>\n<p><b>MADDE 11\u00a0\u2013<\/b>\u00a0(1)\u00a0\u0130\u015fyeri hekimleri, bu Y\u00f6netmelikte belirtilen g\u00f6revlerini yaparken, i\u015fin normal ak\u0131\u015f\u0131n\u0131\u00a0m\u00fcmk\u00fcn oldu\u011fu kadar aksatmamak ve verimli bir\u00a0\u00e7al\u0131\u015fma ortam\u0131n\u0131n sa\u011flanmas\u0131na katk\u0131da bulunmak, i\u015fverenin ve i\u015fyerinin meslek s\u0131rlar\u0131, ekonomik ve ticari durumlar\u0131\u00a0hakk\u0131ndaki bilgiler ile\u00a0\u00e7al\u0131\u015fan\u0131n ki\u015fisel sa\u011fl\u0131k dosyas\u0131ndaki bilgileri gizli tutmakla y\u00fck\u00fcml\u00fcd\u00fcrler.<\/p>\n<p>(2)\u00a0\u0130\u015fyeri hekimleri, i\u015f\u00a0sa\u011fl\u0131\u011f\u0131\u00a0ve g\u00fcvenli\u011fi hizmetlerinin y\u00fcr\u00fct\u00fclmesindeki ihmallerinden dolay\u0131, hizmet sunduklar\u0131\u00a0i\u015fverene kar\u015f\u0131\u00a0sorumludur.<\/p>\n<p>(3)\u00a0\u00c7al\u0131\u015fan\u0131n\u00a0\u00f6l\u00fcm\u00fc\u00a0veya maluliyetiyle sonu\u00e7lanacak\u00a0\u015fekilde v\u00fccut b\u00fct\u00fcnl\u00fc\u011f\u00fcn\u00fcn bozulmas\u0131na neden olan i\u015fkazas\u0131\u00a0veya meslek hastal\u0131\u011f\u0131n\u0131n meydana gelmesinde ihmali tespit edilen i\u015fyeri hekiminin yetki belgesinin ge\u00e7erlili\u011fi alt\u0131ay s\u00fcreyle ask\u0131ya al\u0131n\u0131r. Bu konudaki ihmalin tespitinde kesinle\u015fmi\u015f\u00a0yarg\u0131\u00a0karar\u0131, malull\u00fc\u011f\u00fcn belirlenmesinde ise31\/5\/2006\u00a0tarihli ve 5510 say\u0131l\u0131\u00a0Sosyal Sigortalar ve Genel Sa\u011fl\u0131k Sigortas\u0131\u00a0Kanununun 25 inci maddesindeki kriterler esas al\u0131n\u0131r.<\/p>\n<p>(4)\u00a0\u0130\u015fyeri hekimi, g\u00f6revlendirildi\u011fi i\u015fyerinde yap\u0131lan\u00a0\u00e7al\u0131\u015fmalara ili\u015fkin tespit ve tavsiyeleri ile i\u015fyeri hekiminin g\u00f6revleri ba\u015fl\u0131kl\u0131\u00a0dokuzuncu maddede belirtilen hususlara ait\u00a0\u00e7al\u0131\u015fmalar\u0131n\u0131, i\u015f\u00a0g\u00fcvenli\u011fi uzman\u0131\u00a0ile birlikte yap\u0131lan\u00e7al\u0131\u015fmalar\u0131\u00a0ve gerekli g\u00f6rd\u00fc\u011f\u00fc\u00a0di\u011fer hususlar\u0131\u00a0onayl\u0131\u00a0deftere yazar.<\/p>\n<p>(5)\u00a0\u0130\u015fyeri hekimi, meslek hastal\u0131\u011f\u0131\u00a0\u00f6n tan\u0131s\u0131\u00a0koydu\u011fu vakalar\u0131, Sosyal G\u00fcvenlik Kurumu taraf\u0131ndan yetkilendirilen sa\u011fl\u0131k hizmeti sunucular\u0131na sevk eder.<\/p>\n<p><b>\u0130\u015fyeri hekimlerinin\u00a0\u00e7al\u0131\u015fma s\u00fcreleri<\/b><\/p>\n<p><b>MADDE 12\u00a0\u2013\u00a0<\/b>(1)\u00a0\u0130\u015fyeri hekimleri, bu Y\u00f6netmelikte belirtilen g\u00f6revlerini yerine getirmek i\u00e7in a\u015fa\u011f\u0131da belirtilen s\u00fcrelerde g\u00f6rev yaparlar:<\/p>\n<p>a) 10\u2019dan az\u00a0\u00e7al\u0131\u015fan\u0131\u00a0olan ve az tehlikeli s\u0131n\u0131fta yer alan i\u015fyerlerinde\u00a0\u00e7al\u0131\u015fan ba\u015f\u0131na y\u0131lda en az 25 dakika.<\/p>\n<p>b) Di\u011fer i\u015fyerlerinden:<\/p>\n<p>1) Az tehlikeli s\u0131n\u0131fta yer alanlarda,\u00a0\u00e7al\u0131\u015fan ba\u015f\u0131na ayda en az 4 dakika.<\/p>\n<p>2) Tehlikeli s\u0131n\u0131fta yer alanlarda,\u00a0\u00e7al\u0131\u015fan ba\u015f\u0131na ayda en az 6 dakika.<\/p>\n<p>3)\u00a0\u00c7ok tehlikeli s\u0131n\u0131fta yer alanlarda,\u00a0\u00e7al\u0131\u015fan ba\u015f\u0131na ayda en az 8 dakika.<\/p>\n<p>(2) Az tehlikeli s\u0131n\u0131fta yer alan 2000 ve daha fazla\u00a0\u00e7al\u0131\u015fan\u0131\u00a0olan i\u015fyerlerinde her 2000\u00a0\u00e7al\u0131\u015fan i\u00e7in tam g\u00fcn\u00e7al\u0131\u015facak en az bir i\u015fyeri hekimi g\u00f6revlendirilir.\u00a0\u00c7al\u0131\u015fan say\u0131s\u0131n\u0131n 2000 say\u0131s\u0131n\u0131n tam katlar\u0131ndan fazla olmas\u0131durumunda geriye kalan\u00a0\u00e7al\u0131\u015fan say\u0131s\u0131\u00a0g\u00f6z\u00a0\u00f6n\u00fcnde bulundurularak birinci f\u0131krada belirtilen\u00a0kriterlere\u00a0uygun yeteri kadar i\u015fyeri hekimi ek olarak g\u00f6revlendirilir.<\/p>\n<p>(3) Tehlikeli s\u0131n\u0131fta yer alan 1500 ve daha fazla\u00a0\u00e7al\u0131\u015fan\u0131\u00a0olan i\u015fyerlerinde her 1500\u00a0\u00e7al\u0131\u015fan i\u00e7in tam g\u00fcn\u00a0\u00e7al\u0131\u015facak en az bir i\u015fyeri hekimi g\u00f6revlendirilir.\u00a0\u00c7al\u0131\u015fan say\u0131s\u0131n\u0131n 1500 say\u0131s\u0131n\u0131n tam katlar\u0131ndan fazla olmas\u0131\u00a0durumunda geriye kalan\u00a0\u00e7al\u0131\u015fan say\u0131s\u0131\u00a0g\u00f6z\u00a0\u00f6n\u00fcnde bulundurularak birinci f\u0131krada belirtilen\u00a0kriterlere\u00a0uygun yeteri kadar i\u015fyeri hekimi ek olarak g\u00f6revlendirilir.<\/p>\n<p>(4)\u00a0\u00c7ok tehlikeli s\u0131n\u0131fta yer alan 1000 ve daha fazla\u00a0\u00e7al\u0131\u015fan\u0131\u00a0olan i\u015fyerlerinde her 1000\u00a0\u00e7al\u0131\u015fan i\u00e7in tam g\u00fcn\u00e7al\u0131\u015facak en az bir i\u015fyeri hekimi g\u00f6revlendirilir.\u00a0\u00c7al\u0131\u015fan say\u0131s\u0131n\u0131n 1000 say\u0131s\u0131n\u0131n tam katlar\u0131ndan fazla olmas\u0131durumunda geriye kalan\u00a0\u00e7al\u0131\u015fan say\u0131s\u0131\u00a0g\u00f6z\u00a0\u00f6n\u00fcnde bulundurularak birinci f\u0131krada belirtilen\u00a0kriterlere\u00a0uygun yeteri kadar i\u015fyeri hekimi ek olarak g\u00f6revlendirilir.<\/p>\n<p>(5)\u00a0\u0130\u015fyeri hekiminin g\u00f6revlendirilmesinde s\u00f6zle\u015fmede belirtilen s\u00fcre kadar i\u015fyerinde hizmet sunulur. Birden fazla i\u015fyeri ile k\u0131smi s\u00fcreli i\u015f\u00a0s\u00f6zle\u015fmesi yap\u0131ld\u0131\u011f\u0131\u00a0takdirde bu i\u015fyerleri aras\u0131nda yolda ge\u00e7en s\u00fcreler haftal\u0131k kanuni\u00e7al\u0131\u015fma s\u00fcresinden say\u0131lmaz.<\/p>\n<p><b>\u0130\u015fyeri hekimlerinin belgelendirilmesi<\/b><\/p>\n<p><b>MADDE 13\u00a0\u2013<\/b>\u00a0(1)\u00a0\u0130\u015fyeri hekimli\u011fi belgesi almak isteyen ve i\u015fyeri hekimli\u011fi s\u0131nav\u0131nda ba\u015far\u0131l\u0131\u00a0olan adaylar\u0131n belgelendirme ba\u015fvurular\u0131n\u0131n de\u011ferlendirilmesi amac\u0131yla, her aday i\u00e7in a\u00e7\u0131lacak dosyan\u0131n elektronik ortamda veya yaz\u0131l\u0131olarak e\u011fitim kurumlar\u0131\u00a0taraf\u0131ndan, e\u011fitim programlar\u0131na kat\u0131lmadan do\u011frudan s\u0131nava girecek olan adaylar\u0131n ise Y\u00f6netmeli\u011fin ilgili maddelerinde belirtilen niteliklere sahip olduklar\u0131n\u0131\u00a0g\u00f6steren belgelerin\u00a0\u015fahsen veya posta yoluyla Genel M\u00fcd\u00fcrl\u00fc\u011fe ibraz edilmesi gerekmektedir.<\/p>\n<p>(2) Bu madde uyar\u0131nca ibraz edilmesi gereken belgelerin asl\u0131\u00a0ile birlikte bir\u00a0\u00f6rne\u011finin getirilmesi halinde Genel M\u00fcd\u00fcrl\u00fck\u00e7e tasdiki yap\u0131l\u0131r.<\/p>\n<p>(3) E\u011fitim kurumlar\u0131nca ibraz edilen belgelerin do\u011frulu\u011fundan e\u011fitim kurumlar\u0131,\u00a0\u015fahsen ibraz edilmesi gereken belgelerin g\u00f6re ge\u00e7erli di\u011fer sa\u011fl\u0131k personeli belgesine sahip olmak zorundad\u0131r.<\/p>\n<p>(2) Tam s\u00fcreli i\u015fyeri hekimi g\u00f6revlendirilen i\u015fyerlerinde, di\u011fer sa\u011fl\u0131k personeli g\u00f6revlendirilmesi zorunlu de\u011fildir.<\/p>\n<p>(3) Di\u011fer sa\u011fl\u0131k personelinin g\u00f6revlendirilmesinde, bu Y\u00f6netmeli\u011fe g\u00f6re hesaplanan\u00a0\u00e7al\u0131\u015fma s\u00fcreleri b\u00f6l\u00fcnerek birden fazla ki\u015fiye verilemez.<\/p>\n<p>(4) Vardiyal\u0131\u00a0\u00e7al\u0131\u015fma yap\u0131lan i\u015fyerlerinde i\u015fveren taraf\u0131ndan vardiyalara uygun\u00a0\u015fekilde g\u00f6revlendirme yap\u0131l\u0131r.<\/p>\n<p><b>Di\u011fer sa\u011fl\u0131k personeli belgesi<\/b><\/p>\n<p><b>MADDE 15\u00a0\u2013\u00a0<\/b>(1) Di\u011fer sa\u011fl\u0131k personeli belgesi, 4\u00a0\u00fcnc\u00fc\u00a0maddenin birinci f\u0131kras\u0131n\u0131n (b) bendinde belirtilen unvana sahip ki\u015filerden;<\/p>\n<p>a) Di\u011fer sa\u011fl\u0131k personeli e\u011fitim program\u0131n\u0131\u00a0tamamlayan ve e\u011fitim sonunda Bakanl\u0131k\u00e7a yap\u0131lacak veya yapt\u0131r\u0131lacak di\u011fer sa\u011fl\u0131k personeli s\u0131nav\u0131nda ba\u015far\u0131l\u0131\u00a0olanlara,<\/p>\n<p>b)\u00a0\u0130\u015f\u00a0sa\u011fl\u0131\u011f\u0131\u00a0veya belirtilmi\u015ftir:<\/p>\n<p>a)\u00a0\u0130\u015f\u00a0sa\u011fl\u0131\u011f\u0131\u00a0ve g\u00fcvenli\u011fi hizmetlerinin planlanmas\u0131, de\u011ferlendirilmesi, izlenmesi ve y\u00f6nlendirilmesinde i\u015fyeri hekimi ile birlikte\u00a0\u00e7al\u0131\u015fmak, veri toplamak ve gerekli kay\u0131tlar\u0131\u00a0tutmak.<\/p>\n<p>b)\u00a0\u00c7al\u0131\u015fanlar\u0131n birlikte\u00a0\u00e7al\u0131\u015fmak.<\/p>\n<p>d)\u00a0\u00c7al\u0131\u015fanlar\u0131n sa\u011fl\u0131k e\u011fitiminde g\u00f6rev almak.<\/p>\n<p>e)\u00a0\u0130\u015fyeri bina ve eklentilerinin genel\u00a0hijyen\u00a0\u015fartlar\u0131n\u0131n s\u00fcrekli izlenip denetlemesinde i\u015fyeri hekimiyle birlikte\u00e7al\u0131\u015fmak.<\/p>\n<p>f)\u00a0\u0130\u015fyeri hekimince verilecek i\u015f\u00a0sa\u011fl\u0131\u011f\u0131\u00a0ve g\u00fcvenli\u011fi ile ilgili di\u011fer g\u00f6revleri y\u00fcr\u00fctmek.<\/p>\n<p>g)\u00a0\u0130\u015fyerinde g\u00f6revli\u00a0\u00e7al\u0131\u015fan temsilcisi ve destek elemanlar\u0131n\u0131n\u00a0\u00e7al\u0131\u015fmalar\u0131na destek sa\u011flamak ve bu ki\u015filerle i\u015fbirli\u011fi yapmak.<\/p>\n<p><b>Di\u011fer sa\u011fl\u0131k personelinin yetkileri<\/b><\/p>\n<p><b>MADDE 17\u00a0\u2013<\/b>\u00a0(1)\u00a0\u0130\u015fyerinde g\u00f6revli di\u011fer sa\u011fl\u0131k personelinin yetkileri a\u015fa\u011f\u0131da belirtilmi\u015ftir:<\/p>\n<p>a) G\u00f6revi gere\u011fi i\u015fyerinin b\u00fct\u00fcn b\u00f6l\u00fcmlerinde i\u015f\u00a0sa\u011fl\u0131\u011f\u0131\u00a0ve g\u00fcvenli\u011fi konusunda inceleme ve ara\u015ft\u0131rma yapmak, gerekli bilgi ve belgelere ula\u015fmak ve\u00a0\u00e7al\u0131\u015fanlarla g\u00f6r\u00fc\u015fmek.<\/p>\n<p>b) G\u00f6revinin gerektirdi\u011fi konularda i\u015fveren ve i\u015fyeri hekiminin bilgisi d\u00e2hilinde ilgili kurum ve kurulu\u015flarla i\u015fyerinin i\u00e7\u00a0d\u00fczenlemelerine uygun olarak i\u015fbirli\u011fi yapmak.<\/p>\n<p>(2) Tam s\u00fcreli i\u015f\u00a0s\u00f6zle\u015fmesi ile g\u00f6revlendirilen di\u011fer sa\u011fl\u0131k personeli,\u00a0\u00e7al\u0131\u015ft\u0131\u011f\u0131\u00a0i\u015fyeri ile ilgili mesleki geli\u015fmelerini sa\u011flamaya y\u00f6nelik e\u011fitim, seminer ve panel gibi organizasyonlara kat\u0131lma hakk\u0131na sahiptir. Bu gibi organizasyonlarda ge\u00e7en s\u00fcrelerden bir y\u0131l i\u00e7erisinde toplam be\u015f\u00a0i\u015f\u00a0g\u00fcn\u00fc\u00a0kadar\u0131\u00a0\u00e7al\u0131\u015fma s\u00fcresinden say\u0131l\u0131r ve bu s\u00fcreler sebebiyle di\u011fer sa\u011fl\u0131k personelinin\u00a0\u00fccretinden herhangi bir kesinti yap\u0131lamaz.<\/p>\n<p><b>Di\u011fer sa\u011fl\u0131k personelinin y\u00fck\u00fcml\u00fcl\u00fckleri<\/b><\/p>\n<p><b>MADDE 18\u00a0\u2013<\/b>\u00a0(1)\u00a0\u0130\u015fyerinde g\u00f6revli di\u011fer sa\u011fl\u0131k personeli, bu Y\u00f6netmelikte belirtilen g\u00f6revlerini yaparken, i\u015fin normal ak\u0131\u015f\u0131n\u0131\u00a0m\u00fcmk\u00fcn oldu\u011fu kadar aksatmamak ve verimli bir\u00a0\u00e7al\u0131\u015fma ortam\u0131n\u0131n sa\u011flanmas\u0131na katk\u0131da bulunmak, i\u015fverenin ve i\u015fyerinin meslek s\u0131rlar\u0131, ekonomik ve ticari durumlar\u0131\u00a0hakk\u0131ndaki bilgiler ile\u00a0\u00e7al\u0131\u015fan\u0131n ki\u015fisel sa\u011fl\u0131k dosyas\u0131ndaki bilgileri gizli tutmakla y\u00fck\u00fcml\u00fcd\u00fcrler.<\/p>\n<p>(2)\u00a0\u0130\u015fyerinde g\u00f6revli di\u011fer sa\u011fl\u0131k personeli, i\u015f\u00a0sa\u011fl\u0131\u011f\u0131\u00a0ve g\u00fcvenli\u011fi hizmetlerinin y\u00fcr\u00fct\u00fclmesindeki ihmallerinden dolay\u0131, hizmet sunduklar\u0131\u00a0i\u015fverene kar\u015f\u0131\u00a0sorumludur.<\/p>\n<p>(3) Di\u011fer sa\u011fl\u0131k personeli, g\u00f6revlendirildi\u011fi i\u015fyerinde i\u015f\u00a0sa\u011fl\u0131\u011f\u0131\u00a0ve g\u00fcvenli\u011fine ili\u015fkin tespit ve tavsiyelerini i\u015fyeri hekimine iletmekle y\u00fck\u00fcml\u00fcd\u00fcr.<\/p>\n<p><b>Di\u011fer sa\u011fl\u0131k personelinin\u00a0\u00e7al\u0131\u015fma s\u00fcreleri<\/b><\/p>\n<p><b>MADDE 19\u00a0\u2013\u00a0<\/b>(1) Di\u011fer sa\u011fl\u0131k personeli, bu Y\u00f6netmelikte belirtilen g\u00f6revlerini yerine getirmek i\u00e7in a\u015fa\u011f\u0131da belirtilen s\u00fcrelerde g\u00f6rev yaparlar:<\/p>\n<p>a) 10\u2019dan az\u00a0\u00e7al\u0131\u015fan\u0131\u00a0olan ve az tehlikeli veya tehlikeli s\u0131n\u0131fta yer alan i\u015fyerlerinde\u00a0\u00e7al\u0131\u015fan ba\u015f\u0131na y\u0131lda en az 35 dakika.<\/p>\n<p>b) Di\u011fer i\u015fyerlerinden;<\/p>\n<p>1) Az tehlikeli s\u0131n\u0131fta yer alanlarda,\u00a0\u00e7al\u0131\u015fan ba\u015f\u0131na ayda en az 6 dakika.<\/p>\n<p>2) Tehlikeli s\u0131n\u0131fta yer alanlarda,\u00a0\u00e7al\u0131\u015fan ba\u015f\u0131na ayda en az 9 dakika.<\/p>\n<p>3)\u00a0\u00c7ok tehlikeli s\u0131n\u0131fta yer alanlarda,\u00a0\u00e7al\u0131\u015fan ba\u015f\u0131na ayda en az 12 dakika.<\/p>\n<p>(2) Tam s\u00fcreli i\u015fyeri hekiminin g\u00f6revlendirildi\u011fi i\u015fyerlerinde, di\u011fer sa\u011fl\u0131k personeli g\u00f6revlendirilmesi\u00a0\u015fart\u0131aranmaz. Ancak, i\u015f\u00a0sa\u011fl\u0131\u011f\u0131\u00a0ve g\u00fcvenli\u011fi hizmetlerinin daha etkin sunulmas\u0131\u00a0amac\u0131yla bu i\u015fyerlerinde, i\u015fyeri hekiminin talebi ve i\u015fverenin uygun g\u00f6rmesi halinde di\u011fer sa\u011fl\u0131k personeli g\u00f6revlendirilebilir.<\/p>\n<p>(3) Di\u011fer sa\u011fl\u0131k personelinin g\u00f6revlendirilmesinde s\u00f6zle\u015fmede belirtilen s\u00fcre kadar i\u015fyerinde hizmet sunulur. Birden fazla i\u015fyeri ile k\u0131smi s\u00fcreli i\u015f\u00a0s\u00f6zle\u015fmesi yap\u0131ld\u0131\u011f\u0131\u00a0takdirde bu i\u015fyerleri aras\u0131nda yolda ge\u00e7en s\u00fcreler haftal\u0131k kanuni\u00a0\u00e7al\u0131\u015fma s\u00fcresinden say\u0131lmaz.<\/p>\n<p><b>Di\u011fer sa\u011fl\u0131k personelinin belgelendirilmesi<\/b><\/p>\n<p><b>MADDE 20\u00a0\u2013<\/b>\u00a0(1) Di\u011fer sa\u011fl\u0131k personeli belgesi almak isteyen ve di\u011fer sa\u011fl\u0131k personeli s\u0131nav\u0131nda ba\u015far\u0131l\u0131\u00a0olan adaylar\u0131n belgelendirme ba\u015fvurular\u0131n\u0131n de\u011ferlendirilmesi amac\u0131yla, her aday i\u00e7in a\u00e7\u0131lacak dosyan\u0131n elektronik ortamda veya yaz\u0131l\u0131\u00a0olarak e\u011fitim kurumlar\u0131\u00a0taraf\u0131ndan, e\u011fitim programlar\u0131na kat\u0131lmadan do\u011frudan s\u0131nava girecek olan adaylar\u0131n ise bu Y\u00f6netmeli\u011fin ilgili maddelerinde belirtilen niteliklere sahip olduklar\u0131n\u0131\u00a0g\u00f6steren belgelerin\u00a0\u015fahsen veya posta yoluyla Genel M\u00fcd\u00fcrl\u00fc\u011fe ibraz edilmesi gerekmektedir.<\/p>\n<p>(2) Bu madde uyar\u0131nca ibraz edilmesi gereken belgelerin asl\u0131\u00a0ile birlikte bir\u00a0\u00f6rne\u011finin getirilmesi halinde Genel M\u00fcd\u00fcrl\u00fck\u00e7e tasdiki yap\u0131l\u0131r.<\/p>\n<p>(3) E\u011fitim kurumlar\u0131nca ibraz edilen belgelerin do\u011frulu\u011fundan e\u011fitim kurumlar\u0131,\u00a0\u015fahsen ibraz edilmesi gereken belgelerin do\u011frulu\u011fundan ise\u00a0\u015fah\u0131slar sorumludur.<\/p>\n<p>BE\u015e\u0130NC\u0130\u00a0B\u00d6L\u00dcM<\/p>\n<p>E\u011fitim Kurumlar\u0131na\u00a0\u0130li\u015fkin H\u00fck\u00fcmler<\/p>\n<p><b>E\u011fitim kurumu ba\u015fvuru i\u015flemleri<\/b><\/p>\n<p><b>MADDE 21\u00a0\u2013<\/b>\u00a0(1) E\u011fitim kurumu yetki belgesi almak amac\u0131yla, Genel M\u00fcd\u00fcrl\u00fc\u011fe bir dilek\u00e7e ve a\u015fa\u011f\u0131da belirtilen ekleri ile ba\u015fvurulur:<\/p>\n<p>a) Ticari\u00a0\u015firketler i\u00e7in tescil edildi\u011fini g\u00f6steren Ticaret Sicil Gazetesi.<\/p>\n<p>b)\u00a0\u015eirket ad\u0131na imza yetkisi olanlar\u0131\u00a0g\u00f6steren imza sirk\u00fcleri.<\/p>\n<p>c) E\u011fitim kurumunun sorumlu m\u00fcd\u00fcr\u00fcn\u00fcn e\u011fitici belgesi\u00a0ile;<\/p>\n<p>1) Ticari\u00a0\u015firketler i\u00e7in tam s\u00fcreli i\u015f\u00a0s\u00f6zle\u015fmesi ve kabul\u00a0\u015ferhli g\u00f6revlendirme yaz\u0131s\u0131,<\/p>\n<p>2) Kamu kurum ve kurulu\u015flar\u0131\u00a0ve\u00a0\u00fcniversiteler i\u00e7in tam s\u00fcreli g\u00f6revlendirme yaz\u0131s\u0131,<\/p>\n<p>3)\u00a0\u015eirket orta\u011f\u0131\u00a0olanlar, sorumlu m\u00fcd\u00fcr olarak da g\u00f6rev yapacaklar ise bu g\u00f6revi yapacaklar\u0131na dair taahh\u00fctname.<\/p>\n<p>\u00e7) Tam s\u00fcreli olarak g\u00f6revlendirilen e\u011fiticilerin i\u015f\u00a0s\u00f6zle\u015fmeleri ve e\u011fitici belgeleri.<\/p>\n<p>d) Faaliyet g\u00f6sterilecek yere ait yap\u0131\u00a0kullanma izni belgesi.<\/p>\n<p>e) Faaliyet g\u00f6sterilecek yere ait kira s\u00f6zle\u015fmesi veya tapu senedi veya intifa hakk\u0131\u00a0belgesi.<\/p>\n<p>f) Faaliyet g\u00f6sterilecek yere ait olan ve yetkili makamlarca verilen\u00a0numarataj\u00a0veya adres tespit belgesi.<\/p>\n<p>g) Faaliyet g\u00f6sterilecek yere ait olan ve bu Y\u00f6netmelikte belirtilen b\u00fct\u00fcn b\u00f6l\u00fcmlerin yer ald\u0131\u011f\u0131\u00a01\/50\u00a0\u00f6l\u00e7ekli plan.<\/p>\n<p>\u011f) Tapu k\u00fct\u00fc\u011f\u00fcnde mesken olarak kay\u0131tl\u0131\u00a0bir ana gayrimenkul\u00fcn ba\u011f\u0131ms\u0131z b\u00f6l\u00fcmlerinde e\u011fitim kurumunun faaliyet g\u00f6sterebilece\u011fine dair kat malikleri kurulunun oybirli\u011fiyle ald\u0131\u011f\u0131\u00a0karar\u00a0\u00f6rne\u011fi.<\/p>\n<p>h)\u00a0\u0130lgili mevzuata g\u00f6re faaliyet g\u00f6sterilecek yerde yang\u0131na kar\u015f\u0131\u00a0gerekli tedbirlerin al\u0131nd\u0131\u011f\u0131na ve bu yerde e\u011fitim kurumu a\u00e7\u0131lmas\u0131nda sak\u0131nca olmad\u0131\u011f\u0131na dair yetkili merciler taraf\u0131ndan verilen belge.<\/p>\n<p>(2) Kamu kurum ve kurulu\u015flar\u0131\u00a0i\u00e7in, yaln\u0131zca birinci f\u0131kran\u0131n (c) bendinin (2) numaral\u0131\u00a0alt bendiyle (\u00e7) ve (g) bentlerinde belirtilen belgeler istenir. Ancak e\u011fitim verilecek mek\u00e2n kamu kurumuna ait de\u011filse (a) ve (b) bentleri hari\u00e7di\u011fer bentlerde belirtilen belgeler istenir.<\/p>\n<p>(3)\u00a0\u00dcniversitelerin e\u011fitim kurumu olarak yetkilendirilme taleplerinde ba\u015fvuru rekt\u00f6rl\u00fck\u00e7e yap\u0131l\u0131r.<\/p>\n<p>(4) Bu madde uyar\u0131nca istenen belgelerin asl\u0131\u00a0ile birlikte bir\u00a0\u00f6rne\u011finin getirilmesi halinde, Genel M\u00fcd\u00fcrl\u00fck\u00e7e tasdik edilir.<\/p>\n<p><b>E\u011fitim kurumu yeri ve yerle\u015fim plan\u0131nda aranacak\u00a0\u015fartlar<\/b><\/p>\n<p><b>MADDE 22\u00a0\u2013<\/b>\u00a0(1) E\u011fitim kurumunun yer alaca\u011f\u0131\u00a0binada; meyhane, kahvehane, k\u0131raathane, bar, elektronik oyun merkezleri gibi umuma a\u00e7\u0131k yerler ile a\u00e7\u0131k alkoll\u00fc\u00a0i\u00e7ki sat\u0131lan yerler bulunamaz.<\/p>\n<p>(2) E\u011fitim kurumlar\u0131n\u0131n b\u00fct\u00fcn birimlerinin;<\/p>\n<p>a) Ayn\u0131\u00a0binan\u0131n birbirine biti\u015fik daire veya katlar\u0131nda veya biti\u015fik binalar\u0131n birbirine ba\u011flant\u0131l\u0131\u00a0ayn\u0131\u00a0katlar\u0131nda,<\/p>\n<p>b) Kuruma ait olan bir arsa i\u00e7inde ve birbirine uzakl\u0131\u011f\u0131\u00a0en fazla 100 metre olan m\u00fcstakil binalarda,<\/p>\n<p>olmas\u0131\u00a0gerekir.<\/p>\n<p>(3) Genel M\u00fcd\u00fcrl\u00fckten izin al\u0131nmadan, onaylanm\u0131\u015f\u00a0yerle\u015fim planlar\u0131nda herhangi bir de\u011fi\u015fiklik yap\u0131lamaz ve yerle\u015fim plan\u0131nda belirtilen b\u00f6l\u00fcmler, ama\u00e7lar\u0131\u00a0d\u0131\u015f\u0131nda kullan\u0131lamaz.<\/p>\n<p>(4) E\u011fitim kurumlar\u0131nca, EK-5\u2019teki\u00a0\u00f6rne\u011fine uygun, kurum unvan\u0131na g\u00f6re haz\u0131rlanan ve boy\/en oran\u0131\u00a02\/3 olan tabela as\u0131l\u0131r. Ayn\u0131\u00a0binada, Genel M\u00fcd\u00fcrl\u00fck\u00e7e yetkilendirilen birden fazla kurum bulunmas\u0131\u00a0durumunda, kullan\u0131lacak tabela i\u00e7in Genel M\u00fcd\u00fcrl\u00fck onay\u0131\u00a0al\u0131nmas\u0131\u00a0\u015fart\u0131yla, t\u00fcm unvanlar\u0131\u00a0g\u00f6steren tek bir tabela kullan\u0131labilir.<\/p>\n<p><b>Derslik ve di\u011fer b\u00f6l\u00fcmlerde aranan\u00a0\u015fartlar<\/b><\/p>\n<p><b>MADDE 23\u00a0\u2013\u00a0<\/b>(1) Dersliklerde bulunmas\u0131\u00a0gereken\u00a0\u015fartlar a\u015fa\u011f\u0131da belirtilmi\u015ftir:<\/p>\n<p>a) Dersliklerde 25\u2019ten fazla kursiyer bulunamaz.<\/p>\n<p>b) Dersliklerde kursiyer ba\u015f\u0131na en az 10 metrek\u00fcp hava hacmi bulunur ve derslikler ile di\u011fer b\u00f6l\u00fcmlerin tavan y\u00fckseklikleri 2,40 metreden az olamaz. D\u00f6rt metre\u00a0\u00fczerinde olan y\u00fckseklikler hacim hesab\u0131nda dikkate al\u0131nmaz.<\/p>\n<p>c) Derslik ve di\u011fer b\u00f6l\u00fcmlerde bulunan pencerelerde; do\u011fal havaland\u0131rmaya m\u00fcsaade edecek\u00a0\u015fekilde binan\u0131n d\u0131\u015fcephesinde olmas\u0131, pencere alan\u0131n\u0131n bulundu\u011fu b\u00f6l\u00fcm\u00fcn taban alan\u0131n\u0131n %10 undan az olmamas\u0131\u00a0ve dersliklerde pencerenin yerden y\u00fcksekli\u011finin 90 santimetreden fazla olmamas\u0131\u00a0\u015fartlar\u0131\u00a0aran\u0131r. Binan\u0131n d\u0131\u015f\u00a0cephesinin tamamen veya k\u0131smen camla kapl\u0131\u00a0olmas\u0131\u00a0durumunda uygun\u00a0\u0131s\u0131tma ve havaland\u0131rma sistemi\u00a0\u015fart\u0131\u00a0aran\u0131r.<\/p>\n<p>\u00e7) Derslik kap\u0131lar\u0131n\u0131n geni\u015fli\u011fi 80 santimetreden az olamaz ve kap\u0131\u00a0kasas\u0131n\u0131n i\u00e7ten i\u00e7e\u00a0\u00f6l\u00e7\u00fclmesiyle belirlenir. Derslik kap\u0131lar\u0131\u00a0d\u0131\u015fa do\u011fru a\u00e7\u0131lmal\u0131\u00a0ve\u00a0\u00e7ift tarafl\u0131\u00a0derslik bulunan koridorlarda kar\u015f\u0131l\u0131kl\u0131\u00a0a\u00e7\u0131lmamal\u0131d\u0131r.<\/p>\n<p>(2) Di\u011fer b\u00f6l\u00fcmlerde bulunmas\u0131\u00a0gereken\u00a0\u015fartlar a\u015fa\u011f\u0131da belirtilmi\u015ftir:<\/p>\n<p>a) Sorumlu m\u00fcd\u00fcr odas\u0131, en az 10 metrekare.<\/p>\n<p>b) E\u011fitici odas\u0131\u00a0tek derslik i\u00e7in en az 15 metrekare, birden fazla dersli\u011fin olmas\u0131\u00a0durumunda ise en az 25 metrekare.<\/p>\n<p>c) B\u00fcro hizmetleri, ar\u015fiv ve dosya odas\u0131, en az 15 metrekare; ayr\u0131\u00a0ayr\u0131\u00a0olmalar\u0131\u00a0h\u00e2linde toplam\u0131\u00a0en az 20 metrekare.<\/p>\n<p>\u00e7) Her derslik i\u00e7in erkek ve kad\u0131n ayr\u0131\u00a0olmak\u00a0\u00fczere en az birer tuvalet ve lavabo.<\/p>\n<p>(3) Dinlenme yeri, kurum i\u00e7inde ba\u011f\u0131ms\u0131z bir b\u00f6l\u00fcm h\u00e2linde veya ayr\u0131\u00a0ayr\u0131\u00a0b\u00f6l\u00fcmlerden meydana gelebilir ve tek derslik i\u00e7in en az 20 metrekare, birden fazla dersli\u011fin olmas\u0131\u00a0durumunda ise en az 35 metrekare olur. Alan hesab\u0131nda y\u00f6netim ve e\u011fitime ayr\u0131lan di\u011fer b\u00f6l\u00fcmler ile balkon ve koridorlar dikkate al\u0131nmaz.<\/p>\n<p>(4) E\u011fitimlerde g\u00fcn\u00fcn teknolojisine uygun ara\u00e7\u00a0ve gere\u00e7ler kullan\u0131l\u0131r.<\/p>\n<p>(5) B\u00f6l\u00fcmlerin, alan (metrekare) veya hacim (metrek\u00fcp)\u00a0\u00f6l\u00e7\u00fcm\u00fc\u00a0sonucu\u00a0\u00e7\u0131kan k\u00fcsuratl\u0131\u00a0rakamlar ile kontenjanlar belirlenirken 0,5 ve daha b\u00fcy\u00fck\u00a0\u00e7\u0131kan k\u00fcsuratl\u0131\u00a0rakamlar bir\u00a0\u00fcst tam say\u0131ya y\u00fckseltilir.<\/p>\n<p><b>Ayd\u0131nlatma, g\u00fcr\u00fclt\u00fc\u00a0ve termal konfor\u00a0\u015fartlar\u0131<\/b><\/p>\n<p><b>MADDE 24\u00a0\u2013\u00a0<\/b>(1) E\u011fitim kurumlar\u0131n\u0131n b\u00f6l\u00fcmlerinde yeterli ayd\u0131nlatma ve termal konfor\u00a0\u015fartlar\u0131\u00a0sa\u011flan\u0131r, g\u00fcr\u00fclt\u00fcye kar\u015f\u0131\u00a0gerekli\u00a0\u00f6nlemler al\u0131n\u0131r. Genel M\u00fcd\u00fcrl\u00fck\u00e7e gerekli g\u00f6r\u00fclmesi halinde, durumun tespitine y\u00f6nelik\u00f6l\u00e7\u00fcmlerin yapt\u0131r\u0131lmas\u0131\u00a0istenebilir.<\/p>\n<p><b>E\u011fitim kurumlar\u0131n\u0131n e\u011fitici kadrosu<\/b><\/p>\n<p><b>MADDE 25\u00a0\u2013\u00a0<\/b>(1) E\u011fitim kurumlar\u0131, i\u015fyeri hekimli\u011fi ve di\u011fer sa\u011fl\u0131k personeli e\u011fitim program\u0131\u00a0i\u00e7in bu Y\u00f6netmelikte belirtilen e\u011fitici belgesine sahip olan en az iki hekim ile tam s\u00fcreli, Genel M\u00fcd\u00fcrl\u00fck\u00e7e belirlenecek m\u00fcfredatta belirtilen konulara uygun e\u011fitici belgesine sahip di\u011fer e\u011fiticiler ile k\u0131smi s\u00fcreli i\u015f\u00a0s\u00f6zle\u015fmesi yapar.<\/p>\n<p><b>E\u011fitim kurumlar\u0131n\u0131n yetkilendirilmesi<\/b><\/p>\n<p><b>MADDE 26\u00a0\u2013<\/b>\u00a0(1) E\u011fitim kurumlar\u0131\u00a0taraf\u0131ndan haz\u0131rlanan ba\u015fvuru dosyas\u0131\u00a0Genel M\u00fcd\u00fcrl\u00fck\u00e7e incelenir, posta yoluyla yap\u0131lan ba\u015fvurularda eksiklikler yaz\u0131l\u0131\u00a0olarak,\u00a0\u015fahsen yap\u0131lan m\u00fcracaatlarda ise derhal bildirilir. Dosya\u00a0\u00fczerinde incelemesi tamamlanan ba\u015fvurular i\u00e7in yerinde inceleme yap\u0131l\u0131r.\u00a0\u0130nceleme i\u015flemlerinde tespit edilen eksikliklerin giderilmesi i\u00e7in her defas\u0131nda 30 g\u00fcnden fazla olmamak\u00a0\u00fczere en fazla iki defa s\u00fcre verilir. Belirlenen s\u00fcrelerde eksiklikler giderilmez ise dosya iade edilir ve bir y\u0131l i\u00e7inde tekrar ba\u015fvuru yap\u0131lamaz. Dosya\u00a0\u00fczerinde ve yerinde incelemeleri tamamlanan ba\u015fvurular\u0131n, bu Y\u00f6netmelikte belirtilen\u00a0\u015fartlar\u0131\u00a0ta\u015f\u0131malar\u0131\u00a0halinde, dosyas\u0131nda belirtilen adres ve unvana m\u00fcnhas\u0131ran, en ge\u00e7\u00a010 g\u00fcn i\u00e7inde Genel M\u00fcd\u00fcrl\u00fck\u00e7e EK-6\u2019daki\u00a0\u00f6rne\u011fine uygun yetki belgesi d\u00fczenlenir. Ba\u015fka bir adreste\u00a0\u015fube a\u00e7\u0131lmak istendi\u011fi takdirde, ayn\u0131\u00a0usul ve esaslar d\u00e2hilinde, bu b\u00f6l\u00fcmde belirtilen\u00a0\u015fartlar\u0131n yerine getirilmesi kayd\u0131yla\u00a0\u015fube i\u00e7in ayr\u0131ca yetki belgesi d\u00fczenlenir.<\/p>\n<p>(2) Bu Y\u00f6netmelikteki\u00a0\u015fartlar\u0131\u00a0yerine getirmeyen e\u011fitim kurumlar\u0131na yetki belgesi d\u00fczenlenemez.<\/p>\n<p>(3) E\u011fitim kurumlar\u0131, Genel M\u00fcd\u00fcrl\u00fck\u00e7e d\u00fczenlenen yetki belgesini almad\u0131k\u00e7a e\u011fitim i\u00e7in kat\u0131l\u0131mc\u0131\u00a0kayd\u0131yapamaz ve e\u011fitime ba\u015flayamazlar.<\/p>\n<p>(4) E\u011fitim kurumlar\u0131, a\u015fa\u011f\u0131da belirtilen hususlara uyarlar:<\/p>\n<p>a)\u00a0\u0130sim ve unvanlar T\u00fcrk\u00e7e olarak tescil ettirilir, tabela ve bas\u0131l\u0131\u00a0evrak, bro\u015f\u00fcr, afi\u015f\u00a0ve internet ile di\u011fer dijital ortamlarda herhangi bir ama\u00e7la kullan\u0131lan her t\u00fcrl\u00fc\u00a0yaz\u0131l\u0131\u00a0ve g\u00f6rsel dok\u00fcmanda sadece yetki belgesinde belirtilen isim ve unvanlar yaz\u0131l\u0131r.\u00a0\u0130sim ve unvanlar\u0131n incelenmesinde T\u00fcrk Dil Kurumunca yay\u0131nlanan B\u00fcy\u00fck T\u00fcrk\u00e7e S\u00f6zl\u00fck esas al\u0131n\u0131r ve k\u0131saltmalar isim ve unvan olarak kullan\u0131lamaz.<\/p>\n<p>b)\u00a0\u00d6zel kurulu\u015flar taraf\u0131ndan, kamu kurum ve kurulu\u015flar\u0131na ait olan isimler ticari isim olarak kullan\u0131lamaz.<\/p>\n<p>c) E\u011fitim Kurumu yetki belgeleri en ge\u00e7\u00a0be\u015f\u00a0y\u0131lda bir defa Bakanl\u0131\u011fa vize ettirilir.<\/p>\n<p>(5) E\u011fitim kurumlar\u0131nda, e\u011fitici olarak, sadece bu Y\u00f6netmelikte belirtilen e\u011fitici belgesine sahip olanlar g\u00f6rev alabilirler.<\/p>\n<p><b>E\u011fitim kurumlar\u0131n\u0131n belgelendirilmesi ve vize i\u015flemleri<\/b><\/p>\n<p><b>MADDE 27\u00a0\u2013\u00a0<\/b>(1) Belge almak veya vize i\u015flemlerini yapt\u0131rmak isteyen kurumlar\u0131n;<\/p>\n<p>a) Bu Y\u00f6netmeli\u011fin ilgili h\u00fck\u00fcmlerine uygunluk sa\u011flamalar\u0131,<\/p>\n<p>b) Bakanl\u0131k\u00e7a belirlenen belge veya vize\u00a0\u00fccretini\u00a0\u00f6demeleri,<\/p>\n<p>gereklidir.<\/p>\n<p>(2) Yetkilendirilen kurumlar be\u015f\u00a0y\u0131l\u0131n tamamlanmas\u0131na en fazla 60, en az 45 g\u00fcn kala vize i\u015flemleri i\u00e7in Genel M\u00fcd\u00fcrl\u00fc\u011fe m\u00fcracaat eder. Eksikli\u011fi bulunmayan kurumlar\u0131n vize i\u015flemleri, vize s\u00fcresinin bitiminden\u00a0\u00f6nce Genel M\u00fcd\u00fcrl\u00fck\u00e7e sonu\u00e7land\u0131r\u0131l\u0131r. Yukar\u0131da belirtilen s\u00fcreler i\u00e7inde m\u00fcracaat etmeyen ve vize s\u00fcresi sona erdikten sonra vize i\u015flemlerini tamamlamam\u0131\u015f\u00a0olanlar\u0131n yetki belgelerinin ge\u00e7erlili\u011fi alt\u0131\u00a0ay s\u00fcreyle ask\u0131ya al\u0131n\u0131r. Bu alt\u0131\u00a0ayl\u0131k s\u00fcre boyunca vize i\u015fleminin tamamlanmamas\u0131\u00a0durumunda yetki belgesi Genel M\u00fcd\u00fcrl\u00fck\u00e7e do\u011frudan iptal edilir.<\/p>\n<p>(3) E\u011fitim kurumlar\u0131, herhangi bir sebeple faaliyetlerini b\u0131rakmalar\u0131\u00a0halinde 30 g\u00fcn i\u00e7inde yetki belgelerinin as\u0131llar\u0131n\u0131\u00a0Genel M\u00fcd\u00fcrl\u00fc\u011fe iade eder.<\/p>\n<p>(4) Belgelendirme ve vize a\u015famas\u0131nda ger\u00e7e\u011fe ayk\u0131r\u0131\u00a0belge ibraz etti\u011fi veya beyanda bulundu\u011fu sonradan tespit edilenlere ait belgeler Genel M\u00fcd\u00fcrl\u00fck\u00e7e iptal edilir ve yetkili yarg\u0131\u00a0mercilerine su\u00e7\u00a0duyurusunda bulunulur.<\/p>\n<p><b>E\u011fitim kurumlar\u0131n\u0131n g\u00f6rev, yetki ve sorumluluklar\u0131<\/b><\/p>\n<p><b>MADDE 28\u00a0\u2013\u00a0<\/b>(1) E\u011fitim kurumlar\u0131;<\/p>\n<p>a) E\u011fitim hizmetlerinin bir k\u0131sm\u0131n\u0131\u00a0veya tamam\u0131n\u0131\u00a0ba\u015fka bir ki\u015fi veya kuruma devredemezler.<\/p>\n<p>b) Yetki ald\u0131klar\u0131\u00a0yerde Genel M\u00fcd\u00fcrl\u00fck\u00e7e yetkilendirilmedikleri konularda hizmet veremez ve faaliyette bulunamazlar.<\/p>\n<p>(2) E\u011fitim kurumlar\u0131nda tam veya k\u0131smi s\u00fcreli i\u015f\u00a0s\u00f6zle\u015fmesi ile g\u00f6revlendirilen e\u011fiticilerle ilgili sosyal g\u00fcvenlik mevzuat\u0131ndan do\u011fan bildirim ve prim\u00a0\u00f6deme gibi y\u00fck\u00fcml\u00fcl\u00fcklerin yerine getirilmesi e\u011fitim kurumlar\u0131nca sa\u011flan\u0131r.<\/p>\n<p>(3) Yetki belgelerinin, e\u011fitim kurumu taraf\u0131ndan be\u015f\u00a0y\u0131lda bir vize ettirilmesi zorunludur.<\/p>\n<p>(4) E\u011fitim kurumlar\u0131nca g\u00f6revlendirilen her bir e\u011fitici i\u00e7in bir dosya olu\u015fturulur. Bu dosyada, yap\u0131lan e\u011fitici s\u00f6zle\u015fmesinin bir\u00a0\u00f6rne\u011fi ile sorumlu m\u00fcd\u00fcr taraf\u0131ndan onaylanm\u0131\u015f\u00a0e\u011fitici belgesi\u00a0\u00f6rne\u011fi bulundurulur.<\/p>\n<p>(5) E\u011fitim kurumlar\u0131, ba\u015fvuru esnas\u0131nda adaylardan kat\u0131lacaklar\u0131\u00a0program\u0131n gerektirdi\u011fi\u00a0\u015fartlar\u0131\u00a0kar\u015f\u0131lad\u0131\u011f\u0131n\u0131g\u00f6steren belgeleri istemek ve bu belgelerin sorumlu m\u00fcd\u00fcr taraf\u0131ndan onaylanm\u0131\u015f\u00a0bir\u00a0\u00f6rne\u011fini be\u015f\u00a0y\u0131l s\u00fcreyle her bir aday i\u00e7in a\u00e7\u0131lan dosyada saklamak zorundad\u0131r.<\/p>\n<p>(6) Tam s\u00fcreli i\u015f\u00a0s\u00f6zle\u015fmesiyle g\u00f6revlendirilen e\u011fiticilerden biri, sorumlu m\u00fcd\u00fcr olarak atan\u0131r.<\/p>\n<p>(7) E\u011fitim program\u0131\u00a0s\u00fcresince sorumlu m\u00fcd\u00fcr kurumda haz\u0131r bulunur. Sorumlu m\u00fcd\u00fcr\u00fcn bu s\u00fcre boyunca kurumda bulunmad\u0131\u011f\u0131\u00a0durumlarda, tam s\u00fcreli i\u015f\u00a0s\u00f6zle\u015fmesiyle g\u00f6revlendirilen e\u011fiticilerden birisinin sorumlu m\u00fcd\u00fcre vek\u00e2let amac\u0131yla kurumda bulunmas\u0131\u00a0sa\u011flan\u0131r. Vek\u00e2let eden e\u011fitici, sorumlu m\u00fcd\u00fcr taraf\u0131ndan yap\u0131lmas\u0131\u00a0gereken her t\u00fcrl\u00fc\u00a0i\u015f\u00a0ve i\u015flemin yap\u0131lmas\u0131n\u0131\u00a0sa\u011flar ve g\u00f6revi s\u00fcresince Genel M\u00fcd\u00fcrl\u00fck\u00e7e sorumlu m\u00fcd\u00fcr olarak kabul edilir. Sorumlu m\u00fcd\u00fcr veya vekilinin mevzuat h\u00fck\u00fcmlerine ayk\u0131r\u0131\u00a0davran\u0131\u015flar\u0131ndan ve g\u00f6rev ve sorumluluklar\u0131n\u0131\u00a0yerine getirmesinden e\u011fitim kurumu t\u00fczel ki\u015fili\u011fi sorumludur.<\/p>\n<p>(8) E\u011fitim kurumunda sorumlu m\u00fcd\u00fcr olarak g\u00f6revlendirilen ki\u015finin de\u011fi\u015fmesi veya bu ki\u015finin g\u00f6revinden ayr\u0131lmas\u0131\u00a0durumunda, 30 i\u015f\u00a0g\u00fcn\u00fc\u00a0i\u00e7erisinde yeni sorumlu m\u00fcd\u00fcr atan\u0131r ve durum Genel M\u00fcd\u00fcrl\u00fc\u011fe yaz\u0131yla bildirilir.<\/p>\n<p>(9) E\u011fitim kurumlar\u0131nda g\u00f6rev yapan e\u011fiticilerin i\u015ften ayr\u0131lmas\u0131\u00a0halinde\u00a0\u00fc\u00e7\u00a0i\u015fg\u00fcn\u00fc\u00a0i\u00e7inde durum\u00a0\u0130SG-KAT\u0130P\u00fczerinden e\u011fitim kurumu taraf\u0131ndan bildirilir. 30 g\u00fcn i\u00e7erisinde tam s\u00fcreli g\u00f6revlendirilme zorunlulu\u011fu bulunan e\u011fiticilerin yerine aranan niteliklere sahip personel g\u00f6revlendirilmesi ve\u00a0\u0130SG-KAT\u0130P\u00a0\u00fczerinden Genel M\u00fcd\u00fcrl\u00fc\u011fe bildirilmesi zorunludur.<\/p>\n<p>(10) Genel M\u00fcd\u00fcrl\u00fc\u011fe bildirilen e\u011fitici s\u00f6zle\u015fmeleri, s\u00f6zle\u015fme h\u00fck\u00fcmlerine ayk\u0131r\u0131\u00a0olmayacak\u00a0\u015fekilde, e\u011fitim kurumlar\u0131nca veya e\u011fiticilerce tek tarafl\u0131\u00a0feshedilene kadar, s\u00f6zle\u015fme s\u00fcresince ge\u00e7erlidir. S\u00fcresi dolan s\u00f6zle\u015fmelerin\u0130SG-KAT\u0130P\u00a0\u00fczerinden yenilenmesi durumu yaz\u0131l\u0131\u00a0bildirim olarak kabul edilir.<\/p>\n<p>(11) E\u011fiticiler, g\u00f6rev ald\u0131klar\u0131\u00a0kurumlar\u0131n e\u011fitim programlar\u0131nda, s\u00f6z konusu kurumla d\u00fczenleyerek Genel M\u00fcd\u00fcrl\u00fc\u011fe bildirilmi\u015f\u00a0olan s\u00f6zle\u015fmede belirtilen toplam g\u00f6rev s\u00fcresinden fazla g\u00f6revlendirilemez. Bu h\u00fckm\u00fcn uygulanmas\u0131\u00a0e\u011fiticiler taraf\u0131ndan, takibi ise kurumun sorumlu m\u00fcd\u00fcr\u00fc\u00a0taraf\u0131ndan y\u00fcr\u00fct\u00fcl\u00fcr.<\/p>\n<p>(12) E\u011fitim kurumlar\u0131nca, adaylar\u0131n y\u00fcz y\u00fcze derslere devam durumunu g\u00f6steren\u00a0\u00e7izelge EK-7\u2019deki\u00a0\u00f6rne\u011fine uygun\u00a0\u015fekilde g\u00fcnl\u00fck olarak d\u00fczenlenir ve ders ba\u015flang\u0131c\u0131nda derslikte haz\u0131r bulundurulur. Her dersin tamamlanmas\u0131n\u0131n ard\u0131ndan, imza\u00a0\u00e7izelgelerinin devams\u0131zl\u0131k nedeniyle bo\u015f\u00a0kalan k\u0131s\u0131mlar\u0131\u00a0e\u011fitici taraf\u0131ndan\u00a0\u201cKATILMADI\u201d\u00a0yaz\u0131larak doldurulur ve imza alt\u0131na al\u0131n\u0131r. E\u011fitim g\u00fcn\u00fcn\u00fcn sonunda kat\u0131l\u0131mc\u0131\u00a0devam\u00a0\u00e7izelgesi sorumlu m\u00fcd\u00fcr taraf\u0131ndan onaylan\u0131r. Devam\u00a0\u00e7izelgeleri e\u011fitim kurumlar\u0131nca be\u015f\u00a0y\u0131l s\u00fcreyle saklan\u0131r ve istenmesi halinde kontrol ve denetime yetkili memurlara ibraz edilir.<\/p>\n<p>(13) E\u011fitimi tamamlayan adaylara e\u011fitim kurumlar\u0131\u00a0taraf\u0131ndan, EK-8\u2019deki\u00a0\u00f6rne\u011fine uygun e\u011fitim kat\u0131l\u0131m belgesi d\u00fczenlenir.<\/p>\n<p>(14) Bu Y\u00f6netmelikte e\u011fitim kurumlar\u0131nca d\u00fczenlenmesi gerekti\u011fi belirtilen her t\u00fcrl\u00fc\u00a0belge ve bildirimin do\u011frulu\u011fundan e\u011fitim kurumlar\u0131\u00a0sorumludur.<\/p>\n<p>(15) Bu Y\u00f6netmelikte belirtilen tabela hari\u00e7\u00a0olmak\u00a0\u00fczere, e\u011fitim kurumunun hi\u00e7bir evrak ve dok\u00fcman\u0131nda Bakanl\u0131k logosu veya unvan\u0131\u00a0kullan\u0131lamaz.<\/p>\n<p><b>Sorumlu m\u00fcd\u00fcr\u00fcn g\u00f6rev ve sorumluluklar\u0131<\/b><\/p>\n<p><b>MADDE 29\u00a0\u2013<\/b>\u00a0(1) E\u011fitim kurumu sorumlu m\u00fcd\u00fcr\u00fcn\u00fcn g\u00f6rev ve sorumluluklar\u0131\u00a0a\u015fa\u011f\u0131da belirtilmi\u015ftir:<\/p>\n<p>a) Bakanl\u0131\u011fa elektronik ortam, e-posta, yaz\u0131\u00a0veya faks gibi ara\u00e7lar vas\u0131tas\u0131yla g\u00f6nderilmesi gereken her t\u00fcrl\u00fcbilgi ve belgeyi haz\u0131rlamak ve g\u00f6ndermek.<\/p>\n<p>b) E\u011fitim programlar\u0131n\u0131n onaylanm\u0131\u015f\u00a0\u015fekliyle uygulanmas\u0131n\u0131\u00a0sa\u011flamak.<\/p>\n<p>c) Devam\u00a0\u00e7izelgeleri ile e\u011fitim kat\u0131l\u0131m belgesinin usul\u00fcne uygun\u00a0\u015fekilde d\u00fczenlenmesini sa\u011flamak.<\/p>\n<p>(2) E\u011fitim kurumlar\u0131nca talep edilen veya bildirilen her t\u00fcrl\u00fc\u00a0bilgi ve belgeye ili\u015fkin i\u015f\u00a0ve i\u015flemlerde Genel M\u00fcd\u00fcrl\u00fck taraf\u0131ndan sadece sorumlu m\u00fcd\u00fcr muhatap kabul edilir.<\/p>\n<p><b>E\u011fitim programlar\u0131<\/b><\/p>\n<p><b>MADDE 30\u00a0\u2013<\/b>\u00a0(1) E\u011fitim kurumlar\u0131\u00a0e\u011fitime ba\u015flayabilmek i\u00e7in; Genel M\u00fcd\u00fcrl\u00fck\u00e7e belirlenen m\u00fcfredat esas al\u0131narak haz\u0131rlanan ve e\u011fitim verilecek konulara uygun e\u011fiticiler ile en az bir en fazla iki olmak\u00a0\u00fczere e\u011fiticilerin yedeklerinin de yer ald\u0131\u011f\u0131\u00a0teorik e\u011fitim program\u0131n\u0131\u00a0ve e\u011fitime kat\u0131lacaklar\u0131n listesini e\u011fitimin ba\u015flang\u0131\u00e7\u00a0tarihinden en az\u00fc\u00e7\u00a0i\u015f\u00a0g\u00fcn\u00fc\u00a0\u00f6nce Bakanl\u0131\u011fa elektronik ortamda bildirirler.<\/p>\n<p>(2) Genel M\u00fcd\u00fcrl\u00fck\u00e7e onaylanmam\u0131\u015f\u00a0programlarla e\u011fitime ba\u015flanamaz. Onaylanmam\u0131\u015f\u00a0programla e\u011fitime ba\u015flanmas\u0131\u00a0halinde do\u011facak hukuki sonu\u00e7lardan e\u011fitim kurumlar\u0131\u00a0sorumludur.<\/p>\n<p>(3) E\u011fitim kurumlar\u0131, uygulamal\u0131\u00a0e\u011fitimin yap\u0131laca\u011f\u0131\u00a0i\u015fyerlerinin listesini ve e\u011fitim tarihlerini, teorik e\u011fitimin tamamlanmas\u0131ndan itibaren en ge\u00e7\u00a015 g\u00fcn i\u00e7inde Genel M\u00fcd\u00fcrl\u00fc\u011fe\u00a0\u0130SG-KAT\u0130P\u00a0\u00fczerinden bildirirler.<\/p>\n<p>(4) Adaylar\u0131n, teorik e\u011fitimin en az %90\u2019\u0131na ve i\u015fyeri hekimleri i\u00e7in uygulamal\u0131\u00a0e\u011fitimin tamam\u0131na kat\u0131l\u0131m\u0131zorunludur.<\/p>\n<p>(5) Genel M\u00fcd\u00fcrl\u00fck\u00e7e onaylanm\u0131\u015f\u00a0olan e\u011fitim program\u0131n\u0131n hi\u00e7bir unsurunda de\u011fi\u015fiklik yap\u0131lamaz. Ancak, zorunlu bir nedenin varl\u0131\u011f\u0131\u00a0ve bu nedenin ge\u00e7erli bir belgeye dayand\u0131r\u0131larak Bakanl\u0131\u011f\u0131n onay\u0131n\u0131n al\u0131nmas\u0131\u00a0\u015fart\u0131yla programda g\u00f6revli e\u011fiticilerde de\u011fi\u015fiklik yap\u0131labilir.<\/p>\n<p>(6) E\u011fitim programlar\u0131, kat\u0131l\u0131mc\u0131lar taraf\u0131ndan kolayl\u0131kla g\u00f6r\u00fclebilecek\u00a0\u015fekilde e\u011fitim kurumu i\u00e7erisinde ilan edilir.<\/p>\n<p>(7) Uzaktan e\u011fitim tamamlanmadan y\u00fcz y\u00fcze e\u011fitim ba\u015flat\u0131lamaz.\u00a0\u0130\u015fyeri hekimleri i\u00e7in y\u00fcz y\u00fcze e\u011fitim tamamlanmadan uygulamal\u0131\u00a0e\u011fitim ba\u015flat\u0131lamaz ve uygulamal\u0131\u00a0e\u011fitim\u00a0dahil\u00a0program\u0131n t\u00fcm\u00fc\u00a0tamamlanmadan adaylar s\u0131nava kat\u0131lamazlar.<\/p>\n<p><b>E\u011fitim programlar\u0131na ba\u015fvuru<\/b><\/p>\n<p><b>MADDE 31\u00a0\u2013\u00a0<\/b>(1) E\u011fitim programlar\u0131na kat\u0131lmak isteyen adaylar e\u011fitim kurumlar\u0131na a\u015fa\u011f\u0131daki belgeler ile ba\u015fvururlar:<\/p>\n<p>a) Ba\u015fvuru yap\u0131lan e\u011fitim kurumuna hitaben yaz\u0131lan, aday\u0131n hangi e\u011fitim program\u0131na kat\u0131laca\u011f\u0131n\u0131\u00a0belirten ve T.C. kimlik numaras\u0131\u00a0ile ileti\u015fim bilgilerini i\u00e7eren\u00a0\u0131slak imzal\u0131\u00a0ba\u015fvuru yaz\u0131s\u0131.<\/p>\n<p>b) Aday\u0131n kat\u0131laca\u011f\u0131\u00a0e\u011fitim program\u0131na uygun alanda e\u011fitime sahip oldu\u011funu g\u00f6steren diploma veya ge\u00e7ici mezuniyet belgesi.<\/p>\n<p>c) Aday\u0131n T.C. kimlik numaras\u0131\u00a0bulunan n\u00fcfus c\u00fczdan\u0131\u00a0veya e\u015fde\u011fer belge.<\/p>\n<p>\u00e7)\u00a0\u0130\u015fyeri hekimli\u011fi ve di\u011fer sa\u011fl\u0131k personeli yenileme e\u011fitimlerine kat\u0131lacaklar i\u00e7in ise ge\u00e7erli mevcut belge.<\/p>\n<p>(2) Adaylar\u0131n e\u011fitim programlar\u0131na kat\u0131labilmesi i\u00e7in, ilgili e\u011fitim program\u0131n\u0131n ba\u015flang\u0131\u00e7\u00a0tarihinden\u00a0\u00f6nce e\u011fitimini tamamlam\u0131\u015f\u00a0ve bu e\u011fitime ili\u015fkin mezuniyet diplomas\u0131\u00a0alabilecek yeterlili\u011fe sahip olmalar\u0131\u00a0gerekmektedir. Bu duruma ili\u015fkin gerekli inceleme, ba\u015fvuru yap\u0131lan e\u011fitim kurumu taraf\u0131ndan yap\u0131l\u0131r.<\/p>\n<p>(3) Yukar\u0131da belirtilen belgelerin asl\u0131\u00a0ile birlikte\u00a0\u00f6rne\u011finin getirilmesi halinde e\u011fitim kurumlar\u0131\u00a0taraf\u0131ndan tasdiki yap\u0131l\u0131r. Ba\u015fvuru s\u0131ras\u0131nda ger\u00e7e\u011fe ayk\u0131r\u0131\u00a0belge ve beyanda bulundu\u011fu tespit edilenlerin ba\u015fvurular\u0131\u00a0reddedilir. Bu durumun sonradan tespiti halinde e\u011fitim, s\u0131nav ve belgeleri ge\u00e7ersiz say\u0131l\u0131r.<\/p>\n<p>(4) Bu Y\u00f6netmelikte belirtilen\u00a0\u00e7al\u0131\u015fma s\u00fcrelerinin tespitinde Sosyal G\u00fcvenlik Kurumu kay\u0131tlar\u0131, diploma veya mezuniyet belgelerinin do\u011frulu\u011funun tespitinde Mill\u00ee\u00a0E\u011fitim Bakanl\u0131\u011f\u0131\u00a0veya Y\u00fcksek\u00f6\u011fretim Kurulu kay\u0131tlar\u0131\u00a0esas al\u0131n\u0131r.<\/p>\n<p>ALTINCI B\u00d6L\u00dcM<\/p>\n<p>\u0130\u015fyeri Hekimlerinin ve Di\u011fer Sa\u011fl\u0131k Personelinin E\u011fitim ve S\u0131navlar\u0131<\/p>\n<p><b>\u0130\u015fyeri hekimlerinin e\u011fitimleri<\/b><\/p>\n<p><b>MADDE 32\u00a0\u2013<\/b>\u00a0(1)\u00a0\u0130\u015fyeri hekimlerinin e\u011fitim programlar\u0131\u00a0teorik ve uygulamal\u0131\u00a0olmak\u00a0\u00fczere iki b\u00f6l\u00fcmden olu\u015fur ve program\u0131n i\u00e7eri\u011fi ile programda g\u00f6revli e\u011fiticilerin nitelikleri Genel M\u00fcd\u00fcrl\u00fck\u00e7e belirlenir. E\u011fitim program\u0131n\u0131n s\u00fcresi, teorik k\u0131sm\u0131\u00a0180 saatten, uygulama k\u0131sm\u0131\u00a040 saatten ve toplamda 220 saatten az olamaz ve bu k\u0131s\u0131mlar ancak tek bir program d\u00e2hilinde uygulanabilir. Teorik e\u011fitimin en fazla yar\u0131s\u0131\u00a0uzaktan e\u011fitim ile verilebilir. Uygulamal\u0131\u00a0e\u011fitimler, i\u015fyeri hekimleri i\u00e7in en az bir i\u015fyeri hekiminin g\u00f6revlendirilmi\u015f\u00a0oldu\u011fu i\u015fyerlerinde yap\u0131l\u0131r.<\/p>\n<p><b>Di\u011fer sa\u011fl\u0131k personelinin e\u011fitimleri<\/b><\/p>\n<p><b>MADDE 33\u00a0\u2013<\/b>\u00a0(1) Di\u011fer sa\u011fl\u0131k personelinin e\u011fitim programlar\u0131\u00a0uzaktan ve y\u00fcz y\u00fcze e\u011fitim\u00a0\u015feklinde uygulan\u0131r ve program\u0131n i\u00e7eri\u011fi ile programda g\u00f6revli e\u011fiticilerin nitelikleri Genel M\u00fcd\u00fcrl\u00fck\u00e7e belirlenir. E\u011fitim program\u0131n\u0131n s\u00fcresi 90 saatten az olamaz. Teorik e\u011fitimin en fazla yar\u0131s\u0131\u00a0uzaktan e\u011fitim ile verilebilir.<\/p>\n<p><b>Yenileme e\u011fitimleri<\/b><\/p>\n<p><b>MADDE 34\u00a0\u2013<\/b>\u00a0(1)\u00a0\u0130\u015fyeri hekimli\u011fi ve di\u011fer sa\u011fl\u0131k personeli belgesi sahibi olan ki\u015filerin, belgelerini ald\u0131klar\u0131tarihten itibaren be\u015f\u00a0y\u0131ll\u0131k aral\u0131klarla e\u011fitim kurumlar\u0131\u00a0taraf\u0131ndan d\u00fczenlenecek yenileme e\u011fitim programlar\u0131na kat\u0131lmas\u0131zorunludur.<\/p>\n<p>(2) Yenileme e\u011fitim programlar\u0131n\u0131n s\u00fcresi i\u015fyeri hekimli\u011fi belgesi sahibi olanlar i\u00e7in 30 saatten az, di\u011fer sa\u011fl\u0131k personeli belgesi sahibi olanlar i\u00e7in 18 saatten az olamaz. Bu programlar, y\u00fcz y\u00fcze e\u011fitim\u00a0\u015feklinde uygulan\u0131r ve program\u0131n i\u00e7eri\u011fi ile programda g\u00f6revli e\u011fiticilerin nitelikleri Genel M\u00fcd\u00fcrl\u00fck\u00e7e belirlenir.<\/p>\n<p>(3)\u00a0\u0130\u015fyeri hekimleri ve di\u011fer sa\u011fl\u0131k personelinin temel e\u011fitim program\u0131na kat\u0131lm\u0131\u015f\u00a0olmalar\u0131\u00a0durumunda, al\u0131nan bu e\u011fitimler ki\u015finin mevcut belgesiyle ilgili yenileme e\u011fitiminden say\u0131l\u0131r.<\/p>\n<p><b>S\u0131navlar<\/b><\/p>\n<p><b>MADDE 35\u00a0\u2013\u00a0<\/b>(1)\u00a0\u0130\u015fyeri hekimli\u011fi ve di\u011fer sa\u011fl\u0131k personeli e\u011fitim program\u0131n\u0131\u00a0tamamlayan adaylar\u0131n s\u0131navlar\u0131Genel M\u00fcd\u00fcrl\u00fck\u00e7e yap\u0131l\u0131r veya yapt\u0131r\u0131l\u0131r.<\/p>\n<p>(2) Adaylar, en son kat\u0131ld\u0131klar\u0131\u00a0e\u011fitimin tarihinden itibaren\u00a0\u00fc\u00e7\u00a0y\u0131l i\u00e7inde ilgili s\u0131navlara kat\u0131labilir. Bu s\u0131navlarda ba\u015far\u0131l\u0131\u00a0olamayan veya e\u011fitimin tarihinden itibaren\u00a0\u00fc\u00e7\u00a0y\u0131l i\u00e7inde s\u0131nava kat\u0131lmayan adaylar yeniden e\u011fitim program\u0131na kat\u0131lmak zorundad\u0131r.<\/p>\n<p>(3) Bu Y\u00f6netmelik h\u00fck\u00fcmlerine g\u00f6re e\u011fitim alma\u00a0\u015fart\u0131\u00a0aranmaks\u0131z\u0131n s\u0131navlara kat\u0131l\u0131m hakk\u0131\u00a0tan\u0131nanlar, bu haklar\u0131n\u0131\u00a0en fazla iki defada kullanabilirler. Bu ki\u015filerin s\u0131navlarda iki defa ba\u015far\u0131s\u0131z olmas\u0131\u00a0durumunda, ilgili e\u011fitim program\u0131n\u0131\u00a0tamamlamak\u00a0\u015fart\u0131yla s\u0131navlara kat\u0131labilirler.<\/p>\n<p>(4) S\u0131navlarda 100 puan\u00a0\u00fczerinden en az 70 puan alan adaylar ba\u015far\u0131l\u0131\u00a0say\u0131l\u0131r, s\u0131nav sonu\u00e7lar\u0131na itirazlar s\u0131nav\u0131d\u00fczenleyen kurum taraf\u0131ndan sonu\u00e7land\u0131r\u0131l\u0131r.<\/p>\n<p>YED\u0130NC\u0130\u00a0B\u00d6L\u00dcM<\/p>\n<p>E\u011fiticiler ve Belgelendirme<\/p>\n<p><b>\u0130\u015fyeri hekimli\u011fi ve i\u015f\u00a0g\u00fcvenli\u011fi uzmanl\u0131\u011f\u0131\u00a0e\u011fitici belgesi ile di\u011fer sa\u011fl\u0131k personeli e\u011fitici belgesi<\/b><\/p>\n<p><b>MADDE 36\u00a0\u2013<\/b>\u00a0(1)\u00a0\u0130\u015fyeri hekimli\u011fi ve i\u015f\u00a0g\u00fcvenli\u011fi uzmanl\u0131\u011f\u0131\u00a0e\u011fitici belgesi;<\/p>\n<p>a) Pedagojik\u00a0formasyona\u00a0veya e\u011fiticilerin e\u011fitimi belgesine sahip olan;<\/p>\n<p>1) En az be\u015f\u00a0y\u0131l i\u015fyeri hekimli\u011fi yapt\u0131\u011f\u0131n\u0131\u00a0belgeleyen i\u015fyeri hekimlerine,<\/p>\n<p>2) En az 5 y\u0131ll\u0131k mesleki tecr\u00fcbeye sahip i\u015f\u00a0sa\u011fl\u0131\u011f\u0131\u00a0ve g\u00fcvenli\u011fi veya i\u015f\u00a0sa\u011fl\u0131\u011f\u0131\u00a0program\u0131nda doktora yapm\u0131\u015fhekimlere,<\/p>\n<p>3) En az be\u015f\u00a0y\u0131l tefti\u015f\u00a0yapm\u0131\u015f\u00a0hekim i\u015f\u00a0m\u00fcfetti\u015fleri ile Genel M\u00fcd\u00fcrl\u00fck ve ba\u011fl\u0131\u00a0birimlerinde en az be\u015f\u00a0y\u0131l fiilen g\u00f6rev yapm\u0131\u015f\u00a0hekimlere,<\/p>\n<p>4)\u00a0\u0130\u015f\u00a0ve meslek hastal\u0131klar\u0131\u00a0ya da i\u015fyeri hekimli\u011fi yan dal uzmanlar\u0131na veya meslek hastal\u0131klar\u0131\u00a0hastanelerinde\u00a0\u00fc\u00e7y\u0131l\u00a0\u00e7al\u0131\u015fm\u0131\u015f\u00a0olan hekimlere,<\/p>\n<p>b) M\u00fchendis, mimar, fizik\u00e7i, kimyager, teknik\u00a0\u00f6\u011fretmen, hukuk\u00e7u ve hekimlerden Genel M\u00fcd\u00fcrl\u00fck\u00e7e ilan edilen e\u011fitim programlar\u0131na uygun olarak\u00a0\u00fcniversitelerde en az d\u00f6rt yar\u0131y\u0131l ders veren\u00a0\u00f6\u011fretim\u00a0\u00fcyelerine,<\/p>\n<p>ba\u015fvurmalar\u0131\u00a0halinde, EK-9\u2019daki\u00a0\u00f6rne\u011fine uygun olarak d\u00fczenlenir.<\/p>\n<p>(2) Di\u011fer sa\u011fl\u0131k personeli e\u011fitici belgesi;<\/p>\n<p>a) Di\u011fer sa\u011fl\u0131k personeli tan\u0131m\u0131nda belirtilen unvanlara ve pedagojik\u00a0formasyona\u00a0veya e\u011fiticilerin e\u011fitimi belgesine sahip olanlardan;<\/p>\n<p>1) En az be\u015f\u00a0y\u0131ll\u0131k mesleki tecr\u00fcbeye sahip i\u015f\u00a0sa\u011fl\u0131\u011f\u0131\u00a0ve g\u00fcvenli\u011fi veya i\u015f\u00a0sa\u011fl\u0131\u011f\u0131\u00a0program\u0131nda doktora yapm\u0131\u015folanlara,<\/p>\n<p>2) Genel M\u00fcd\u00fcrl\u00fck ve ba\u011fl\u0131\u00a0birimlerinde en az be\u015f\u00a0y\u0131l fiilen g\u00f6rev yapm\u0131\u015f\u00a0olanlara,<\/p>\n<p>3) Meslek hastal\u0131klar\u0131\u00a0hastanelerinde en az\u00a0\u00fc\u00e7\u00a0y\u0131l g\u00f6rev yapm\u0131\u015f\u00a0olanlara,<\/p>\n<p>b)\u00a0\u00dcniversitelerde Genel M\u00fcd\u00fcrl\u00fck\u00e7e ilan edilen di\u011fer sa\u011fl\u0131k personeli e\u011fitim program\u0131na uygun, en az d\u00f6rt yar\u0131y\u0131l ders veren\u00a0\u00f6\u011fretim\u00a0\u00fcyelerine<\/p>\n<p>ba\u015fvurmalar\u0131\u00a0halinde, EK-10\u2019daki\u00a0\u00f6rne\u011fine uygun di\u011fer sa\u011fl\u0131k personeli e\u011fitici belgesi d\u00fczenlenir.<\/p>\n<p>(3) Bu Y\u00f6netmelik kapsam\u0131nda i\u015fyeri hekimli\u011fi ve i\u015f\u00a0g\u00fcvenli\u011fi uzmanl\u0131\u011f\u0131\u00a0e\u011fitici belgesi sahibi olanlar, i\u015fyeri hekimli\u011fi, i\u015f\u00a0g\u00fcvenli\u011fi uzmanl\u0131\u011f\u0131\u00a0ve di\u011fer sa\u011fl\u0131k personeli e\u011fitim programlar\u0131\u00a0ile bu programlara ili\u015fkin yenileme e\u011fitimlerinde, di\u011fer sa\u011fl\u0131k personeli e\u011fitici belgesi sahibi olanlar ise di\u011fer sa\u011fl\u0131k personeli e\u011fitim programlar\u0131\u00a0ile bu programlara ili\u015fkin yenileme e\u011fitimlerinde Genel M\u00fcd\u00fcrl\u00fck\u00e7e belirlenecek m\u00fcfredatta yer alan\u00a0\u015fartlara uygunluk sa\u011flanmas\u0131\u00a0\u015fart\u0131yla g\u00f6rev alabilirler.<\/p>\n<p><b>E\u011fiticilerin g\u00f6rev ve sorumluluklar\u0131<\/b><\/p>\n<p><b>MADDE 37\u00a0\u2013<\/b>\u00a0(1) 36\u00a0nc\u0131\u00a0maddeye g\u00f6re e\u011fitici belgesi alm\u0131\u015f\u00a0olanlar, Genel M\u00fcd\u00fcrl\u00fck\u00e7e belirlenecek e\u011fitim m\u00fcfredat\u0131nda kendilerine verilen g\u00f6revleri yerine getirir ve m\u00fcfredatta belirtilen konu i\u00e7eriklerinin tamam\u0131n\u0131n derslerde ele al\u0131nmas\u0131n\u0131\u00a0ve\u00a0\u00f6\u011frenim hedeflerine ula\u015f\u0131lmas\u0131n\u0131\u00a0sa\u011flar.<\/p>\n<p>(2) E\u011fitim kurumlar\u0131nda g\u00f6revli olan e\u011fiticiler, Bakanl\u0131\u011fa bildirilen s\u00f6zle\u015fmelerde belirtilen s\u00fcrelerden fazla g\u00f6rev alamaz.<\/p>\n<p>(3) E\u011fitim kurumunda tam s\u00fcreli olarak g\u00f6revlendirilen e\u011fiticiler, i\u015fyerlerinde i\u015f\u00a0g\u00fcvenli\u011fi uzman\u0131, i\u015fyeri hekimi veya di\u011fer sa\u011fl\u0131k personeli unvan\u0131yla veya ba\u015fka bir e\u011fitim kurumunda e\u011fitici unvan\u0131yla g\u00f6rev alamaz.<\/p>\n<p><b>E\u011fiticilerin belgelendirilmesi<\/b><\/p>\n<p><b>MADDE 38\u00a0\u2013<\/b>\u00a0(1)\u00a0\u0130\u015fyeri hekimli\u011fi ve i\u015f\u00a0g\u00fcvenli\u011fi uzmanl\u0131\u011f\u0131\u00a0e\u011fitici belgesi veya di\u011fer sa\u011fl\u0131k personeli e\u011fitici belgesi alma niteliklerine sahip olup, bu belgeyi almak isteyenlerin ba\u015fvurular\u0131n\u0131n de\u011ferlendirilebilmesi amac\u0131yla; pedagojik\u00a0formasyon\u00a0veya e\u011fiticilerin e\u011fitimi belgesi ile 37\u00a0nci\u00a0maddede belirtilen nitelikleri haiz olduklar\u0131n\u0131\u00a0g\u00f6steren belgeleri, Genel M\u00fcd\u00fcrl\u00fc\u011fe hitaben yaz\u0131lm\u0131\u015f\u00a0dilek\u00e7e ekinde\u00a0\u015fahsen veya posta yoluyla Genel M\u00fcd\u00fcrl\u00fc\u011fe teslim etmesi gerekmektedir.<\/p>\n<p>(2)\u00a0\u00dcniversitelerde Genel M\u00fcd\u00fcrl\u00fck\u00e7e ilan edilen e\u011fitim programlar\u0131na uygun alanlarda ders verenlerin bu durumlar\u0131n\u0131\u00a0g\u00f6steren belgelerinde, rekt\u00f6r onay\u0131\u00a0\u015fart\u0131\u00a0aran\u0131r.<\/p>\n<p>(3) Bu madde uyar\u0131nca ibraz edilmesi gereken belgelerin asl\u0131\u00a0ile birlikte bir\u00a0\u00f6rne\u011finin getirilmesi halinde Genel M\u00fcd\u00fcrl\u00fck\u00e7e tasdiki yap\u0131l\u0131r ve\u00a0\u015fahsen ibraz edilmesi gereken belgelerin do\u011frulu\u011fundan belge sahipleri sorumludur.<\/p>\n<p>SEK\u0130Z\u0130NC\u0130\u00a0B\u00d6L\u00dcM<\/p>\n<p>\u00c7e\u015fitli ve Son H\u00fck\u00fcmler<\/p>\n<p><b>Genel M\u00fcd\u00fcrl\u00fc\u011f\u00fcn g\u00f6rev, yetki ve sorumluluklar\u0131<\/b><\/p>\n<p><b>MADDE 39\u00a0\u2013<\/b>\u00a0(1) Genel M\u00fcd\u00fcrl\u00fck e\u011fitimlerin etkin ve verimli bir\u00a0\u015fekilde verilip verilmedi\u011finin izlenmesi amac\u0131yla kendi g\u00f6rev ve yetki alan\u0131na giren konularda e\u011fitim kurumlar\u0131n\u0131, e\u011fiticileri ve sorumlu m\u00fcd\u00fcrleri, yetki al\u0131nan mek\u00e2n\u0131,\u00a0\u0130SG-KAT\u0130P\u00a0ile di\u011fer elektronik sistemler veya evrak\u00a0\u00fczerinden kontrol eder ve denetler.<\/p>\n<p>(2) Yetkilendirme ve belgelendirme a\u015famalar\u0131nda ger\u00e7e\u011fe ayk\u0131r\u0131\u00a0belge ibraz edildi\u011fi veya beyanda bulunuldu\u011funun bu a\u015famalarda veya daha sonradan tespiti halinde d\u00fczenlenen belgeler Genel M\u00fcd\u00fcrl\u00fck\u00e7e do\u011frudan iptal edilir.<\/p>\n<p>(3) E\u011fitim kurumlar\u0131nca y\u00fcr\u00fct\u00fclen her t\u00fcrl\u00fc\u00a0i\u015f\u00a0ve i\u015fleme ili\u015fkin takip, kontrol, izleme, onay verme, ba\u015fvuru alma gibi faaliyetler, yaz\u0131l\u0131\u00a0olarak ger\u00e7ekle\u015ftirilebilece\u011fi gibi, elektronik sistemler vas\u0131tas\u0131yla da y\u00fcr\u00fct\u00fclebilir. Bu konuda d\u00fczenleme yapmaya Genel M\u00fcd\u00fcrl\u00fck yetkilidir.<\/p>\n<p>(4) Belgesinin ge\u00e7erlili\u011fi ask\u0131ya al\u0131nanlar ve do\u011frudan iptal edilenlere Genel M\u00fcd\u00fcrl\u00fck\u00e7e yaz\u0131l\u0131\u00a0bildirim yap\u0131l\u0131r ve Genel M\u00fcd\u00fcrl\u00fck internet sayfas\u0131nda ilan edilir. Belgesinin ge\u00e7erlili\u011fi ask\u0131ya al\u0131nan ki\u015fi ve kurumlar\u0131n belgelerini tekrar kullanabilmeleri i\u00e7in Genel M\u00fcd\u00fcrl\u00fck onay\u0131n\u0131n al\u0131nmas\u0131\u00a0zorunludur.<\/p>\n<p>(5) Bu Y\u00f6netmelik uyar\u0131nca ki\u015fi ve kurumlara uygulanan ihtar puanlar\u0131na ili\u015fkin itirazlar, ihtar puan\u0131n\u0131n tebli\u011ftarihinden itibaren en ge\u00e7\u00a010 i\u015fg\u00fcn\u00fc\u00a0i\u00e7inde Genel M\u00fcd\u00fcrl\u00fc\u011fe yap\u0131l\u0131r. Bu s\u00fcreden sonra yap\u0131lacak itirazlar dikkate al\u0131nmaz.<\/p>\n<p>(6) E\u011fitim kurumlar\u0131nda g\u00f6rev alan e\u011fiticilerin listesi Genel M\u00fcd\u00fcrl\u00fck\u00e7e Sosyal G\u00fcvenlik Kurumuna bildirilir.<\/p>\n<p><b>\u0130hlaller ve ihtar puan\u0131\u00a0uygulanmas\u0131<\/b><\/p>\n<p><b>MADDE 40\u00a0\u2013<\/b>\u00a0(1) 36\u00a0nc\u0131\u00a0maddede yer alan yetki belgesinin ge\u00e7erlili\u011finin do\u011frudan iptalini gerektiren durumlar\u0131n d\u0131\u015f\u0131ndaki ihlallerde, EK-11 ve EK-12\u2019de belirtilen ihtar puanlar\u0131\u00a0uygulan\u0131r.<\/p>\n<p>(2) Bir takvim y\u0131l\u0131\u00a0i\u00e7inde hafif ihlallerin ihtar puanlar\u0131n\u0131n toplam\u0131n\u0131n 30\u2019a, orta ihlallerin ihtar puanlar\u0131n\u0131n toplam\u0131n\u0131n 60\u2019a ula\u015fmas\u0131\u00a0durumunda ki\u015fi ve kurumlar\u0131n o y\u0131l i\u00e7inde i\u015fleyecekleri di\u011fer hafif ve orta ihlaller bir\u00a0\u00fcst derecenin tavan puan\u0131\u00a0esas al\u0131narak uygulan\u0131r.<\/p>\n<p>(3) Be\u015f\u00a0y\u0131ll\u0131k s\u00fcrenin sonunda vize i\u015flemini tamamlayan ki\u015fi ve kurumlar\u0131n; uygulanmas\u0131n\u0131n\u00a0\u00fczerinden en az bir y\u0131l ge\u00e7mi\u015f\u00a0olan t\u00fcm ihtar puanlar\u0131\u00a0silinir.<\/p>\n<p><b>Yetkilerin ask\u0131ya al\u0131nmas\u0131\u00a0ve iptali<\/b><\/p>\n<p><b>MADDE 41\u00a0\u2013<\/b>\u00a0(1) Bu Y\u00f6netmelik uyar\u0131nca yetkilendirilen veya belgelendirilen ki\u015fi ve kurumlar\u0131n belgelerinin ge\u00e7erlili\u011fi;<\/p>\n<p>a)\u00a0\u0130htar puanlar\u0131\u00a0toplam\u0131n\u0131n, ki\u015filer i\u00e7in 100, kurumlar i\u00e7in 200 puana ula\u015fmas\u0131,<\/p>\n<p>b) Denetim veya kontrollerde tespit edilen noksanl\u0131klar\u0131n giderilmesi i\u00e7in verilen en fazla 30 g\u00fcnl\u00fck s\u00fcre sonunda noksanl\u0131klar\u0131n devam etmesi,<\/p>\n<p>hallerinden\u00a0birinin ger\u00e7ekle\u015fmesi durumunda alt\u0131\u00a0ay s\u00fcreyle ask\u0131ya al\u0131n\u0131r.<\/p>\n<p>(2) Yetki belgelerinin ge\u00e7erlili\u011finin alt\u0131\u00a0ay s\u00fcreyle ask\u0131ya al\u0131nmas\u0131\u00a0i\u015flemini gerektiren durumlar\u0131n bir vize s\u00fcresi i\u00e7inde tekrar\u0131\u00a0halinde bir y\u0131l s\u00fcreyle yetki belgesinin ge\u00e7erlili\u011fi ask\u0131ya al\u0131n\u0131r.<\/p>\n<p>(3) Yetki belgelerinin ge\u00e7erlili\u011fi ask\u0131ya al\u0131nan ki\u015fi ve kurumlar ask\u0131ya al\u0131nma s\u00fcresince bu Y\u00f6netmelik kapsam\u0131ndaki yetkilerini kullanamazlar. Ancak, yetki belgesinin ge\u00e7erlili\u011fi ask\u0131ya al\u0131nan veya belgesi do\u011frudan iptal edilen e\u011fitim kurumunun faaliyeti y\u00fcz y\u00fcze e\u011fitimi ba\u015flam\u0131\u015f\u00a0olan onayl\u0131\u00a0program bitinceye kadar devam eder. Ask\u0131ya al\u0131nma s\u00fcresi, program\u0131n bitiminde ba\u015flar. Yetki belgesi do\u011frudan iptal edilen kurumlar taahh\u00fct ettikleri hizmetleri herhangi bir ek\u00a0\u00fccret talep etmeden bir ba\u015fka e\u011fitim kurumundan temin etmek zorundad\u0131rlar.<\/p>\n<p>(4) Yetki belgesinin ge\u00e7erlili\u011finin ask\u0131ya al\u0131nmas\u0131\u00a0veya do\u011frudan iptali durumunda\u00a0\u00f6nceden yap\u0131lan aday kay\u0131t i\u015flemlerinden do\u011fan hukuki sonu\u00e7lardan iptal edilen veya ge\u00e7erlili\u011fi ask\u0131ya al\u0131nan yetki belgesi sahipleri sorumludur.<\/p>\n<p>(5) Bu Y\u00f6netmelik uyar\u0131nca yetkilendirilen ki\u015fi ve kurumlar\u0131n yetki belgeleri;<\/p>\n<p>a) Bakanl\u0131k\u00e7a belirlenen esaslara ayk\u0131r\u0131\u00a0\u015fekilde\u00a0\u015fube a\u00e7malar\u0131, yetki ald\u0131\u011f\u0131\u00a0adres veya il s\u0131n\u0131rlar\u0131\u00a0d\u0131\u015f\u0131nda hizmet vermeleri,<\/p>\n<p>b) Sunmakla y\u00fck\u00fcml\u00fc\u00a0olduklar\u0131\u00a0hizmetlerin tamam\u0131n\u0131\u00a0veya bir k\u0131sm\u0131n\u0131\u00a0devretmeleri,<\/p>\n<p>c) Bir vize d\u00f6neminde\u00a0\u00fc\u00e7\u00fcnc\u00fc\u00a0defa yetki belgelerinin ge\u00e7erlili\u011finin ask\u0131ya al\u0131nmas\u0131n\u0131\u00a0gerektiren\u00a0\u015fartlar\u0131n olu\u015fmas\u0131,<\/p>\n<p>\u00e7) Yetki belgesinin amac\u0131\u00a0d\u0131\u015f\u0131nda kullan\u0131ld\u0131\u011f\u0131n\u0131n tespiti,<\/p>\n<p>d) Belgesi ask\u0131da olan ki\u015fi ve kurumlar\u0131n bu s\u00fcre i\u00e7inde faaliyetleri ile ilgili s\u00f6zle\u015fme yapt\u0131klar\u0131n\u0131n veya hizmet vermelerinin tespiti,<\/p>\n<p>hallerinden\u00a0birinin varl\u0131\u011f\u0131\u00a0halinde do\u011frudan iptal edilir.<\/p>\n<p>(6) Bakanl\u0131\u011fa bildirilen s\u00f6zle\u015fme veya e\u011fitim kat\u0131l\u0131m belgesi gibi her t\u00fcrl\u00fc\u00a0evrakta ger\u00e7e\u011fe ayk\u0131r\u0131\u00a0beyan veya imzan\u0131n tespit edilmesi halinde, e\u011fitim kurumunun yetki belgesi do\u011frudan iptal edilir, sorumlu m\u00fcd\u00fcr\u00fcn e\u011fitici belgesinin ge\u00e7erlili\u011fi ise 1 y\u0131l s\u00fcreyle ask\u0131ya al\u0131n\u0131r. Ayn\u0131\u00a0tespitte e\u011fiticilerin kusurunun olmas\u0131\u00a0halinde, kusuru olan e\u011fiticinin belgesinin ge\u00e7erlili\u011fi 1 y\u0131l s\u00fcreyle ask\u0131ya al\u0131n\u0131r.<\/p>\n<p>(7) Belgesi iptal edilen i\u015fyeri hekimli\u011fi ve i\u015f\u00a0g\u00fcvenli\u011fi uzmanl\u0131\u011f\u0131\u00a0veya di\u011fer sa\u011fl\u0131k personeli e\u011fitici belgesi sahiplerinin iptal tarihinden itibaren iki y\u0131l i\u00e7erisinde yapt\u0131\u011f\u0131\u00a0ba\u015fvurular, iki y\u0131l\u0131n tamamlanmas\u0131na kadar ask\u0131ya al\u0131n\u0131r.<\/p>\n<p>(8) Yetki belgesi iptal edilen e\u011fitim kurumlar\u0131\u00a0ve bu kurumlarda kurucu veya ortak olanlar\u0131n iptal tarihinden itibaren\u00a0\u00fc\u00e7\u00a0y\u0131l i\u00e7erisinde yapt\u0131\u011f\u0131\u00a0ba\u015fvurular,\u00a0\u00fc\u00e7\u00a0y\u0131l\u0131n tamamlanmas\u0131na kadar ask\u0131ya al\u0131n\u0131r. Bahsi ge\u00e7en kurucu veya ortaklar\u0131n yetkili bir e\u011fitim kurumuna ortak olmalar\u0131\u00a0halinde, bu kurumun yetki belgesi birinci c\u00fcmlede belirtilen s\u00fcrenin sonuna kadar ask\u0131ya al\u0131n\u0131r.<\/p>\n<p><b>Mesleki ba\u011f\u0131ms\u0131zl\u0131k ve etik ilkeler<\/b><\/p>\n<p><b>MADDE 42\u00a0\u2013<\/b>\u00a0(1)\u00a0\u0130\u015f\u00a0sa\u011fl\u0131\u011f\u0131\u00a0ve g\u00fcvenli\u011fi hizmetleri ve bu Y\u00f6netmelik kapsam\u0131ndaki e\u011fitimlerde g\u00f6revlendirilenler;<\/p>\n<p>a) Sa\u011fl\u0131k ve g\u00fcvenlik riskleri konusunda, i\u015fveren ve\u00a0\u00e7al\u0131\u015fanlara\u00a0\u00f6nerilerde bulunurken hi\u00e7bir etki alt\u0131nda kalmazlar.<\/p>\n<p>b) Hizmet sunduklar\u0131\u00a0ki\u015filerle g\u00fcven, gizlilik ve e\u015fitli\u011fe dayanan bir ili\u015fki kurar ve ayr\u0131m g\u00f6zetmeksizin t\u00fcm\u00fcn\u00fce\u015fit olarak de\u011ferlendirirler.<\/p>\n<p>c)\u00a0\u00c7al\u0131\u015fma ortam\u0131\u00a0ve ko\u015fullar\u0131n\u0131n d\u00fczenlenmesinde, kendi aralar\u0131nda, y\u00f6netici ve\u00a0\u00e7al\u0131\u015fanlarla ileti\u015fime a\u00e7\u0131k ve i\u015fbirli\u011fi i\u00e7erisinde hareket ederler.<\/p>\n<p>(2) Mesleki ba\u011f\u0131ms\u0131zl\u0131\u011f\u0131n sonu\u00e7lar\u0131\u00a0hi\u00e7bir\u00a0\u015fekilde i\u015f\u00a0sa\u011fl\u0131\u011f\u0131\u00a0ve g\u00fcvenli\u011fi hizmetlerinde g\u00f6revlendirilenlerin aleyhine kullan\u0131lamaz ve yap\u0131lan s\u00f6zle\u015fmelere mesleki anlamda ba\u011f\u0131ms\u0131z\u00a0\u00e7al\u0131\u015fmay\u0131\u00a0k\u0131s\u0131tlayabilecek\u00a0\u015fartlar konulamaz.<\/p>\n<p>(3)\u00a0\u0130\u015f\u00a0sa\u011fl\u0131\u011f\u0131\u00a0ve g\u00fcvenli\u011fi hizmetleri ile bu Y\u00f6netmelik kapsam\u0131ndaki e\u011fitimlerde g\u00f6revlendirilenlerin hak ve yetkileri, g\u00f6revlerini yerine getirmeleri nedeniyle k\u0131s\u0131tlanamaz. Bu ki\u015filer, g\u00f6revlerini ve uzmanl\u0131k bilgilerini mesle\u011fin gerektirdi\u011fi etik ilkeler ve mesleki ba\u011f\u0131ms\u0131zl\u0131k i\u00e7erisinde s\u00fcrd\u00fcr\u00fcr.<\/p>\n<p><b>Y\u00fcr\u00fcrl\u00fckten kald\u0131r\u0131lan y\u00f6netmelik<\/b><\/p>\n<p><b>MADDE 43\u00a0\u2013<\/b>\u00a0(1)\u00a027\/11\/2010\u00a0tarihli ve 27768 say\u0131l\u0131\u00a0Resm\u00ee\u00a0Gazete\u2019de yay\u0131mlanan\u00a0\u0130\u015fyeri Hekimlerinin G\u00f6rev, Yetki, Sorumluluk ve E\u011fitimleri Hakk\u0131ndaki Y\u00f6netmelik y\u00fcr\u00fcrl\u00fckten kald\u0131r\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p><b>Mevcut e\u011fitim kurumlar\u0131n\u0131n durumu<\/b><\/p>\n<p><b>GE\u00c7\u0130C\u0130\u00a0MADDE 1\u00a0\u2013\u00a0<\/b>(1) Mevcut e\u011fitim kurumlar\u0131n\u0131n onaylanm\u0131\u015f\u00a0yerle\u015fim plan\u0131nda de\u011fi\u015fiklik olmas\u0131\u00a0halinde, fiziki\u00a0\u015fartlar\u0131n bu Y\u00f6netmelik h\u00fck\u00fcmlerine uygun olmas\u0131\u00a0\u015fart\u0131\u00a0aran\u0131r.<\/p>\n<p>(2) Mevcut e\u011fitim kurumlar\u0131\u00a0bu Y\u00f6netmeli\u011fin yay\u0131mlanmas\u0131ndan itibaren alt\u0131\u00a0ay i\u00e7erisinde EK-5\u2019teki\u00a0\u00f6rne\u011fine uygun tabelay\u0131, kurumun bulundu\u011fu binan\u0131n giri\u015fine veya kurumun giri\u015fine asarlar.
